Narrative:
We were level at 5000 ft heading 180 degrees (I think). ATC called traffic at 12 - 1 O'clock position. First officer was PF. He called traffic in sight. ATC told us to turn to 070 degrees and descend to 4000 ft immediately. We did so. Controller said the other aircraft had busted our altitude. Not sure how close we got -- maybe 2-3 mi. Controller did a good job. Might have been a problem if controller didn't catch altitude deviation of other aircraft as we are not mandated to have TCASII yet.

Title: INTRUDER ACFT OVERSHOOTS ALT CAUSING AN INCURSION OF A DC9 ASSIGNED INTERMEDIATE DEP ALT.
Narrative: WE WERE LEVEL AT 5000 FT HDG 180 DEGS (I THINK). ATC CALLED TFC AT 12 - 1 O'CLOCK POS. FO WAS PF. HE CALLED TFC IN SIGHT. ATC TOLD US TO TURN TO 070 DEGS AND DSND TO 4000 FT IMMEDIATELY.
