Narrative:
In climb out from ege, VMC, captain flying, copilot on radios. Given climb from 15000 ft (estimated) to higher altitude, then given heading. Copilot reads back heading '050 degrees, FL230,' places in MCP, captain verifies FL230, no response from ATC to contrary. Captain engages autoplt in climb. Center calls traffic at 12:30 O'clock position and ? Mi. Captain and first officer outside searching (VMC) traffic sighted. TCASII indicates traffic at 800 ft. Captain and first officer verify visual with each other. Ca[T asks first officer query ATC on traffic's altitude. Before first officer can transmit, air carrier Y calls and says he has a target at 6 O'clock position closing his altitude. Captain disengages autoplt and starts descent. ATC responds to air carrier Y. He's (air carrier X) at FL220. We are in descent with RA. First officer verifies in sight aircraft passes under air carrier Y at FL220 TCASII 'clear of conflict' prior to passing. Closest approach estimated 300 ft, 3 mi. Captain and first officer both felt cleared to FL230, ie, easterly heading, typical step altitude assignment, and readback not challenged. Our indication of improper altitude was TA on TCASII and ATC's response to 'he's at FL220.' crew had traffic in sight and took comfortable evasive action maneuver to avoid traffic, passing under at FL220, and not to induce a maneuver that provided excessive g-loads to aircraft and cabin. Crew did not lose visual contact or feel excessive maneuvering was necessary to avoid conflict. I feel our last readback of altitude '230 with heading' verified our assigned altitude. Additional voice traffic during event precluded an earlier and possibly timely prevention of situational developments prior to receiving a TCASII RA. Supplemental information from acn 496855: our corrective action was not severe (no passenger/crew discomfort) and upon initial visual contact, visual contact was maintained until passing of traffic. Lengthy communication between conflicting traffic and ATC, largely precluded our ability to interject useful communication with ATC. Flight attendant entered flight deck during initial cruise at 15000 ft. High performance aft should be immediately queried of ability to climb to higher/planned altitudes and given clearance to do so to get out of higher density/close proximity lower altitudes. In this event, the author of this report was not given a speed assignment which would have markedly changed (improved) the ability to avoid this situation and reduce closure rates. (We were climbing at 305 KTS and conflicting traffic was in cruise at FL230 with speed unknown.)

CAPT AND FO BOTH FELT CLRED TO FL230, IE, EASTERLY HDG, TYPICAL STEP ALT ASSIGNMENT, AND READBACK NOT CHALLENGED. OUR INDICATION OF IMPROPER ALT WAS TA ON TCASII AND ATC'S RESPONSE TO 'HE'S AT FL220.' CREW HAD TFC IN SIGHT AND TOOK COMFORTABLE EVASIVE ACTION MANEUVER TO AVOID TFC, PASSING UNDER AT FL220, AND NOT TO INDUCE A MANEUVER THAT PROVIDED EXCESSIVE G-LOADS TO ACFT AND CABIN. CREW DID NOT LOSE VISUAL CONTACT OR FEEL EXCESSIVE MANEUVERING WAS NECESSARY TO AVOID CONFLICT. I FEEL OUR LAST READBACK OF ALT '230 WITH HDG' VERIFIED OUR ASSIGNED ALT. LENGTHY COM BTWN CONFLICTING TFC AND ATC, LARGELY PRECLUDED OUR ABILITY TO INTERJECT USEFUL COM WITH ATC. FLT ATTENDANT ENTERED FLT DECK DURING INITIAL CRUISE AT 15000 FT. HIGH PERFORMANCE AFT SHOULD BE IMMEDIATELY QUERIED OF ABILITY TO CLB TO HIGHER/PLANNED ALTS AND GIVEN CLRNC TO DO SO TO GET OUT OF HIGHER DENSITY/CLOSE PROX LOWER ALTS. IN THIS EVENT, THE AUTHOR OF THIS RPT WAS NOT GIVEN A SPD ASSIGNMENT WHICH WOULD HAVE MARKEDLY CHANGED (IMPROVED) THE ABILITY TO AVOID THIS SIT AND REDUCE CLOSURE RATES.
