Narrative:
After takeoff during flap retraction the flap fail caution message appeared on the EICAS. The flaps were at 8 degree while the flap lever was at 0 degree. After running the QRH and notifying the flight attendant, passengers, dispatch, and maintenance, we declared an emergency as a precautionary measure and returned to ZZZ. Callback conversation with reporter revealed the following information: the reporter stated the flap system was inspected prior to flight per the airworthiness directive and found ok. The reporter said this flap control problem is on going and has happened several times to the reporter.

Title: A CANADAIR CL-65 ON INITIAL CLB DECLARED AND EMER AND DIVERTED DUE TO LOSS OF TRAILING EDGE FLAP CTL.
Narrative: AFTER TKOF DURING FLAP RETRACTION THE FLAP FAIL CAUTION MSG APPEARED ON THE EICAS. THE FLAPS WERE AT 8 DEG WHILE THE FLAP LEVER WAS AT 0 DEG. AFTER RUNNING THE QRH AND NOTIFYING THE FA, PASSENGERS, DISPATCH, AND MAINT, WE DECLARED AN EMER AS A PRECAUTIONARY MEASURE AND RETURNED TO ZZZ. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THE RPTR STATED THE FLAP SYS WAS INSPECTED PRIOR TO FLT PER THE AIRWORTHINESS DIRECTIVE AND FOUND OK. THE RPTR SAID THIS FLAP CTL PROB IS ON GOING AND HAS HAPPENED SEVERAL TIMES TO THE RPTR.
