Narrative:
FL350, received clearance from oak to descend to FL310. I read back 'air carrier XXXX, descend and maintain FL310.' 60 mi east of mod, descending through FL324, ATC said 'air carrier XXXX, turn right 40 degrees, maintain 330.' I said 'we were cleared to 310, do you want us to climb back up to FL330?' ATC said 'yes, you were cleared to FL330.' I said 'I read back FL310.' ATC did not respond. Upon leveloff at FL330, ATC cleared us direct mod with no further comments. The initial clearance from ATC was slightly garbled. I thought I heard FL310, so I read that back to ATC. I accepted hs lack of response as clarification of his clearance to FL310. Next time there is any hesitation on my part, I will ask ATC for clarification.

Narrative: FL350, RECEIVED CLRNC FROM OAK TO DSND TO FL310. I READ BACK 'ACR XXXX, DSND AND MAINTAIN FL310.' 60 MI E OF MOD, DSNDING THROUGH FL324, ATC SAID 'ACR XXXX, TURN R 40 DEGS, MAINTAIN 330.' I SAID 'WE WERE CLRED TO 310, DO YOU WANT US TO CLB BACK UP TO FL330?' ATC SAID 'YES, YOU WERE CLRED TO FL330.' I SAID 'I READ BACK FL310.' ATC DID NOT RESPOND. UPON LEVELOFF AT FL330, ATC CLRED US DIRECT MOD WITH NO FURTHER COMMENTS. THE INITIAL CLRNC FROM ATC WAS SLIGHTLY GARBLED. I THOUGHT I HEARD FL310, SO I READ THAT BACK TO ATC. I ACCEPTED HS LACK OF RESPONSE AS CLARIFICATION OF HIS CLRNC TO FL310. NEXT TIME THERE IS ANY HESITATION ON MY PART, I WILL ASK ATC FOR CLARIFICATION.
