Narrative:
I vectored aircraft a to a departure heading, clear of other traffic and climbed the aircraft to 4000 ft. Aircraft B crossed behind, diverging from aircraft a, but an FAA evaluator who was observing, claimed loss of separation. The observer has a different interpretation of the applicable rule in this instance and the issue is being investigated.

Title: FAA EVALUATOR QUESTIONS C90 CTLR'S APPLICATION OF SEPARATION BTWN A CLBING DA20 AND MD80, WHICH IS LATER DETERMINED TO BE AN OPERROR.
Narrative: I VECTORED ACFT A TO A DEP HEADING, CLR OF OTHER TFC AND CLBED THE ACFT TO 4000 FT. ACFT B CROSSED BEHIND, DIVERGING FROM ACFT A, BUT AN FAA EVALUATOR WHO WAS OBSERVING, CLAIMED LOSS OF SEPARATION. THE OBSERVER HAS A DIFFERENT INTERP OF THE APPLICABLE RULE IN THIS INSTANCE AND THE ISSUE IS BEING INVESTIGATED.
