Narrative:
Lancair departed trk approximately XA45 VFR to pao, flight following entire route. Contacted bay approach with pao ATIS information. Requested VOR/DME pao runway 31 approach. Directed to maintain 4500 ft vectors toward sjc VOR, xfer frequency, direct sjc at 4500 ft VFR. Traffic given for MD80 departing sjc right turn climb out from runway 30. MD80 traffic in sight through entire event period. Lancair approximately 3 mi north heading approximately 185 degrees off sjc at 4500 ft direct sjc VOR. MD80 climbing right turn then heading approximately 120 degrees, VFR conditions. The 2 aircraft converged rapidly -- vertically and horizontally. Lancair pilot and passenger observing MD80 at or close to lancair altitude and appearing to be climbing at distance of less than 1/2 mi. Lancair descended 4500 ft to 4200 ft indicated altitude, and turned left slightly. MD80 turned right and passed in front and slightly above lancair. MD80 horizontal distance approximately 1000 ft, vertical approximately 200 ft above lancair. Lancair returned to 4500 ft and completed approach to pao. Lancair contacted approach control immediately at time of diversion and return to 4500 ft. Diversion required for safety separation.

Title: GA PLT INITIATES EVASIVE MANEUVER FROM ISSUED ACR TFC DEPARTING SJC WHILE UNDER O90 CTL.
Narrative: LANCAIR DEPARTED TRK APPROX XA45 VFR TO PAO, FLT FOLLOWING ENTIRE RTE. CONTACTED BAY APCH WITH PAO ATIS INFO. REQUESTED VOR/DME PAO RWY 31 APCH. DIRECTED TO MAINTAIN 4500 FT VECTORS TOWARD SJC VOR, XFER FREQ, DIRECT SJC AT 4500 FT VFR. TFC GIVEN FOR MD80 DEPARTING SJC R TURN CLBOUT FROM RWY 30. MD80 TFC IN SIGHT THROUGH ENTIRE EVENT PERIOD. LANCAIR APPROX 3 MI N HDG APPROX 185 DEGS OFF SJC AT 4500 FT DIRECT SJC VOR. MD80 CLBING R TURN THEN HDG APPROX 120 DEGS, VFR CONDITIONS. THE 2 ACFT CONVERGED RAPIDLY -- VERTLY AND HORIZLY. LANCAIR PLT AND PAX OBSERVING MD80 AT OR CLOSE TO LANCAIR ALT AND APPEARING TO BE CLBING AT DISTANCE OF LESS THAN 1/2 MI. LANCAIR DSNDED 4500 FT TO 4200 FT INDICATED ALT, AND TURNED L SLIGHTLY. MD80 TURNED R AND PASSED IN FRONT AND SLIGHTLY ABOVE LANCAIR. MD80 HORIZ DISTANCE APPROX 1000 FT, VERT APPROX 200 FT ABOVE LANCAIR. LANCAIR RETURNED TO 4500 FT AND COMPLETED APCH TO PAO. LANCAIR CONTACTED APCH CTL IMMEDIATELY AT TIME OF DIVERSION AND RETURN TO 4500 FT. DIVERSION REQUIRED FOR SAFETY SEPARATION.
