Narrative:
In accordance with issued NOTAMS I filed an IFR flight plan to conduct a 135 VFR air taxi charter. After these flts of 9/mon/01 and 9/tue/01 I was contacted by FAA FSDO and told that those flts were part 91. I of course disagree because I was carrying passenger and landed at a different airport than I departed from. During the flight conducted on 9/mon/01 video was taken. During the flight conducted 9/tue/01 radio broadcast were made. These flts were conducted and complied with part 119 and part 135. It is the position of the FAA FSDO that I was in violation, because I should have conducted these flts to a lower standard part 91 not to the higher standard of part 135.

Title: BELL HELI206, PLT OPERATED PHOTO AND MEDIA BROADCASTING FLTS ON TWO SEPARATE DAYS IN THE NY AREA UNDER THE PROVISION OF A NOTAM ALLOWING IFR PART 135 FLTS. FAA INSPECTOR BELIEVES THAT THESE FLTS WERE ACTUALLY PART 91 TYPE FLTS AND WERE NOT IN ACCORDANCE WITH THE PAX CARRYING RULES, OR ACFT REQUIREMENTS, OF PART 135.
Narrative: IN ACCORDANCE WITH ISSUED NOTAMS I FILED AN IFR FLT PLAN TO CONDUCT A 135 VFR AIR TAXI CHARTER. AFTER THESE FLTS OF 9/MON/01 AND 9/TUE/01 I WAS CONTACTED BY FAA FSDO AND TOLD THAT THOSE FLTS WERE PART 91. I OF COURSE DISAGREE BECAUSE I WAS CARRYING PAX AND LANDED AT A DIFFERENT ARPT THAN I DEPARTED FROM. DURING THE FLT CONDUCTED ON 9/MON/01 VIDEO WAS TAKEN. DURING THE FLT CONDUCTED 9/TUE/01 RADIO BROADCAST WERE MADE. THESE FLTS WERE CONDUCTED AND COMPLIED WITH PART 119 AND PART 135. IT IS THE POS OF THE FAA FSDO THAT I WAS IN VIOLATION, BECAUSE I SHOULD HAVE CONDUCTED THESE FLTS TO A LOWER STANDARD PART 91 NOT TO THE HIGHER STANDARD OF PART 135.
