Narrative:

FAA inspector idented waste chute doors in forward lavatory 100 and aft lavatory 136 as being unacceptable in the fact that they did not fully close. Contacted ZZZ and with 'opb' concurrence, dispatched with 2 lavatories inoperative. Samc sent placard and crew performed required inspection of lavatories and secured them. 2 hours into flight, purser informed captain that both lavatories were getting full and shortly thereafter that they were inoperative. Captain invoked captain's authority/authorized to open lavatories with the following precautions: taped over waste chute, plastic trash bag provided outside of lavatory and flight attendants inspect lavatories after each use. Flight completed normally from that point forward.

Title: A B767 FLC OVERRIDES SOME OBJECTIONS OF AN FAA ACI REGARDING THE DEFICIENCIES FOUND ON BOARD THEIR ACFT, BOTH BEFORE FLT AND AFTER AIRBORNE FROM SMF, CA.

Narrative: FAA INSPECTOR IDENTED WASTE CHUTE DOORS IN FORWARD LAVATORY 100 AND AFT LAVATORY 136 AS BEING UNACCEPTABLE IN THE FACT THAT THEY DID NOT FULLY CLOSE. CONTACTED ZZZ AND WITH 'OPB' CONCURRENCE, DISPATCHED WITH 2 LAVATORIES INOP. SAMC SENT PLACARD AND CREW PERFORMED REQUIRED INSPECTION OF LAVATORIES AND SECURED THEM. 2 HRS INTO FLT, PURSER INFORMED CAPT THAT BOTH LAVATORIES WERE GETTING FULL AND SHORTLY THEREAFTER THAT THEY WERE INOP. CAPT INVOKED CAPT'S AUTH TO OPEN LAVATORIES WITH THE FOLLOWING PRECAUTIONS: TAPED OVER WASTE CHUTE, PLASTIC TRASH BAG PROVIDED OUTSIDE OF LAVATORY AND FLT ATTENDANTS INSPECT LAVATORIES AFTER EACH USE. FLT COMPLETED NORMALLY FROM THAT POINT FORWARD.
