Narrative:
Climbing out from mco we received clearance to 10000 ft with traffic (VFR) called by departure at 2 O'clock position, 5-10 NM (?) leveling at 10500 ft. I, PNF, called traffic in sight on TCASII. Controller responded with climb and maintain 14000 ft. TCASII went white solid, yellow, red very quickly. Captain, PF, responded to TCASII descent while I, PNF, told ATC we were responding to TCASII. We topped out at approximately 11000 ft and descended to approximately 10000 ft. VFR traffic passed 500-1000 ft above us. ATC said I thought you had him in sight and I said we had to follow TCASII. VFR pilot said he thought we were climbing above him. Maneuver was smooth, no comments from cabin, no other discussion on VHF occurred since we were switched to ZJX. Traffic lights were in sight but darkness didn't portray VFR traffic as a threat. PF responded to ATC's request to climb in a normal fashion. ATC never indicated that we were ever given responsibility to maintain visual separation.

Narrative: CLBING OUT FROM MCO WE RECEIVED CLRNC TO 10000 FT WITH TFC (VFR) CALLED BY DEP AT 2 O'CLOCK POS, 5-10 NM (?) LEVELING AT 10500 FT. I, PNF, CALLED TFC IN SIGHT ON TCASII. CTLR RESPONDED WITH CLB AND MAINTAIN 14000 FT. TCASII WENT WHITE SOLID, YELLOW, RED VERY QUICKLY. CAPT, PF, RESPONDED TO TCASII DSCNT WHILE I, PNF, TOLD ATC WE WERE RESPONDING TO TCASII. WE TOPPED OUT AT APPROX 11000 FT AND DSNDED TO APPROX 10000 FT. VFR TFC PASSED 500-1000 FT ABOVE US. ATC SAID I THOUGHT YOU HAD HIM IN SIGHT AND I SAID WE HAD TO FOLLOW TCASII. VFR PLT SAID HE THOUGHT WE WERE CLBING ABOVE HIM. MANEUVER WAS SMOOTH, NO COMMENTS FROM CABIN, NO OTHER DISCUSSION ON VHF OCCURRED SINCE WE WERE SWITCHED TO ZJX. TFC LIGHTS WERE IN SIGHT BUT DARKNESS DIDN'T PORTRAY VFR TFC AS A THREAT. PF RESPONDED TO ATC'S REQUEST TO CLB IN A NORMAL FASHION. ATC NEVER INDICATED THAT WE WERE EVER GIVEN RESPONSIBILITY TO MAINTAIN VISUAL SEPARATION.
