Narrative:
At approximately XA30Z, we were operating as flight abcd from ord to ZZZ, we received message from EICAS of flaps fail 'caution.' proper procedures and checklists were accomplished, dispatch and company maintenance were notified of the situation, emergency was declared, flight attendant and passengers were notified, all procedures and checklists were accomplished as per air carrier operational manual and flight standards manual, safe landing was accomplished without any injuries or damage to the aircraft. Aircraft was inspected by maintenance, flaps system was reset and was given a 72 hour deferral per gmm 4-3 CAT I and ad 98-20-01 per maintenance controller engineering authorization and returned to service. Callback conversation with reporter revealed the following information: the reporter stated the required ad note inspection of the flaps was accomplished prior to departure. In flight, the EICAS flap fail 'caution' warning message was received which precludes flap operation. The airplane was landed flaps up with no problems. On the ground, maintenance reset the flap control system module and entered a deferred item for 72 hours on the flaps with the condition if a second flap failure occurred the airplane would be grounded. The reporter stated this deferral appeared illegal and the maintenance controller was contacted and was reported as legal deferral using the ad and an engineering authorization. A call was made to pilot union and again was assured the deferral was legal. The reporter stated the airplane was operated for two legs and no flap problems were noted.

Narrative: AT APPROX XA30Z, WE WERE OPERATING AS FLT ABCD FROM ORD TO ZZZ, WE RECEIVED MSG FROM EICAS OF FLAPS FAIL 'CAUTION.' PROPER PROCS AND CHKLISTS WERE ACCOMPLISHED, DISPATCH AND COMPANY MAINT WERE NOTIFIED OF THE SIT, EMER WAS DECLARED, FA AND PASSENGERS WERE NOTIFIED, ALL PROCEDURES AND CHKLISTS WERE ACCOMPLISHED AS PER ACR OPERATIONAL MANUAL AND FLT STANDARDS MANUAL, SAFE LNDG WAS ACCOMPLISHED WITHOUT ANY INJURIES OR DAMAGE TO THE ACFT. ACFT WAS INSPECTED BY MAINT, FLAPS SYSTEM WAS RESET AND WAS GIVEN A 72 HR DEFERRAL PER GMM 4-3 CAT I AND AD 98-20-01 PER MAINT CTLR ENGINEERING AUTHORIZATION AND RETURNED TO SVC.
