Narrative:
During climb out from sna, we were given an unrestr climb and direct to fix bhose. Local altimeter was 30.08 and we were on a heading of approximately 120 degrees. We were not given any TA's and did not have any targets on TCASII. The sun was right in our face, which restr our visibility out the front windscreen. Passing 9500 ft, we spotted a civilian aircraft about 1-2 seconds before it passed by us co-altitude. It passed off our right side by approximately 200 ft. We did not take evasive action because there was not enough time to react. The aircraft was blue/white, high wing, and fixed landing gear -- similar to a C172. We told ATC about it and they said they were not talking to anyone and were only showing a small primary target in the area.

Title: B757 EXPERIENCED NMAC WITH SMA AT 9500 FT ON DEP FROM SNA. NO TCASII WARNING, NO TIME TO ATTEMPT AVOIDANCE MANEUVER.
Narrative: DURING CLBOUT FROM SNA, WE WERE GIVEN AN UNRESTR CLB AND DIRECT TO FIX BHOSE. LCL ALTIMETER WAS 30.08 AND WE WERE ON A HEADING OF APPROX 120 DEGS. WE WERE NOT GIVEN ANY TA'S AND DID NOT HAVE ANY TARGETS ON TCASII. THE SUN WAS RIGHT IN OUR FACE, WHICH RESTR OUR VISIBILITY OUT THE FRONT WINDSCREEN. PASSING 9500 FT, WE SPOTTED A CIVILIAN ACFT ABOUT 1-2 SECONDS BEFORE IT PASSED BY US CO-ALT. IT PASSED OFF OUR R SIDE BY APPROX 200 FT. WE DID NOT TAKE EVASIVE ACTION BECAUSE THERE WAS NOT ENOUGH TIME TO REACT. THE ACFT WAS BLUE/WHITE, HIGH WING, AND FIXED LNDG GEAR -- SIMILAR TO A C172. WE TOLD ATC ABOUT IT AND THEY SAID THEY WERE NOT TALKING TO ANYONE AND WERE ONLY SHOWING A SMALL PRIMARY TARGET IN THE AREA.
