Narrative:
The arriving crew briefed me of a problem with the 3A hydraulic pump being weak causing a gear disagree warning message on the inbound leg. Maintenance was in the aircraft as I arrived. The write-up in the aml (aircraft maintenance log) stated that the previous crew got a 'system 3 hydraulic pressure low caution' message. Maintenance deferred the hydraulic system 3A pump. The MEL required the 3B pump be run continuously. I asked maintenance about the gear disagree message the previous captain reported and he stated that he and the previous captain had decided the problem was a weak system 3A pump, and if they wrote up the 'gear disagree message' it would ground the aircraft until they could swing the gear. I succumbed to his assessment of the problem and departed per the MEL procedures. After takeoff when we retracted the gear we got a 'gear disagree' warning message and the left main gear showed not in the up and locked position. Following our QRH and checklists we lowered the gear, got 3 green lights, called dispatch and returned to ZZZ. After blocking in I wrote up the gear disagree warning message in the aml. This incident would not have occurred if the previous crew had wrote up the problem correctly.
Original NASA ASRS Text
Title: A CANADAIR CL65 WAS DISPATCHED IN NON COMPLIANCE WITH A MAIN GEAR WARNING RPTED INCORRECTLY IN LOG. DIVERTED DUE TO MAIN GEAR WARNING.
Narrative: THE ARRIVING CREW BRIEFED ME OF A PROB WITH THE 3A HYD PUMP BEING WEAK CAUSING A GEAR DISAGREE WARNING MESSAGE ON THE INBOUND LEG. MAINT WAS IN THE ACFT AS I ARRIVED. THE WRITE-UP IN THE AML (ACFT MAINT LOG) STATED THAT THE PREVIOUS CREW GOT A 'SYS 3 HYD PRESSURE LOW CAUTION' MESSAGE. MAINT DEFERRED THE HYD SYS 3A PUMP. THE MEL REQUIRED THE 3B PUMP BE RUN CONTINUOUSLY. I ASKED MAINT ABOUT THE GEAR DISAGREE MESSAGE THE PREVIOUS CAPT RPTED AND HE STATED THAT HE AND THE PREVIOUS CAPT HAD DECIDED THE PROB WAS A WEAK SYS 3A PUMP, AND IF THEY WROTE UP THE 'GEAR DISAGREE MESSAGE' IT WOULD GND THE ACFT UNTIL THEY COULD SWING THE GEAR. I SUCCUMBED TO HIS ASSESSMENT OF THE PROB AND DEPARTED PER THE MEL PROCS. AFTER TKOF WHEN WE RETRACTED THE GEAR WE GOT A 'GEAR DISAGREE' WARNING MESSAGE AND THE L MAIN GEAR SHOWED NOT IN THE UP AND LOCKED POS. FOLLOWING OUR QRH AND CHKLISTS WE LOWERED THE GEAR, GOT 3 GREEN LIGHTS, CALLED DISPATCH AND RETURNED TO ZZZ. AFTER BLOCKING IN I WROTE UP THE GEAR DISAGREE WARNING MESSAGE IN THE AML. THIS INCIDENT WOULD NOT HAVE OCCURRED IF THE PREVIOUS CREW HAD WROTE UP THE PROB CORRECTLY.
