Narrative:

I am part owner of a cessna R182 (skylane rg ii). The aircraft is based at chesterfield county airport near richmond, va (fci). I have made flts into MD31 many times for the purpose of picking up or dropping off my mother-in-law. On most of these occasions, I am only on the ground for a brief period. It is typical for me to advise the last controller (potomac approach -- previously baltimore approach) that I will only be on the ground for a few mins and that I have an IFR flight plan on file for the departure. I ask for the clearance, or at least a transponder code, before landing. The controllers are almost always able to accommodate my request. On those occasions when the controllers have been too busy to provide my departure clearance prior to landing, I have followed a procedure that has always worked quite well. Since they know I will be popping up soon, I tell the controller that I will depart VFR and circle over the field to await 'radar contact' whereupon I am typically given a vector and, shortly thereafter, my full clearance. Baltimore's class B airspace does not cover MD31 and, so, prior to the creation of the ADIZ, this was not a problem. On the flight in question, as I was approaching MD31 to land, I asked the controller for my departure clearance, but he was quite busy at the time and could not provide it. I, therefore, advised him that I would only be on the ground a short time and suggested that I depart VFR, and pick up my clearance in the air while circling over the airport. His reply was that he would be expecting me and that he would try to have my clearance ready by the time I was airborne. I took off and climbed while circling over the airport. Upon calling potomac approach, I was give a transponder code. After establishing radar contact, I was then given my clearance. It now occurs to me that the controller's tacit approval (prior to landing) of my suggested procedure may not have been an official clearance to enter the ADIZ prior to my initial radio call after departure. In the future, when I am on such a trip with a short time on the ground at MD31, I will be sure that I have a departure clearance before I land or I will get it by phone before taking off.

Title: A C182R PLT ENTERED THE DC ADIZ WITHOUT PERMISSION.

ON THOSE OCCASIONS WHEN THE CTLRS HAVE BEEN TOO BUSY TO PROVIDE MY DEP CLRNC PRIOR TO LNDG, I HAVE FOLLOWED A PROC THAT HAS ALWAYS WORKED QUITE WELL. SINCE THEY KNOW I WILL BE POPPING UP SOON, I TELL THE CTLR THAT I WILL DEPART VFR AND CIRCLE OVER THE FIELD TO AWAIT 'RADAR CONTACT' WHEREUPON I AM TYPICALLY GIVEN A VECTOR AND, SHORTLY THEREAFTER, MY FULL CLRNC. BALTIMORE'S CLASS B AIRSPACE DOES NOT COVER MD31 AND, SO, PRIOR TO THE CREATION OF THE ADIZ, THIS WAS NOT A PROB. ON THE FLT IN QUESTION, AS I WAS APCHING MD31 TO LAND, I ASKED THE CTLR FOR MY DEP CLRNC, BUT HE WAS QUITE BUSY AT THE TIME AND COULD NOT PROVIDE IT. I, THEREFORE, ADVISED HIM THAT I WOULD ONLY BE ON THE GND A SHORT TIME AND SUGGESTED THAT I DEPART VFR, AND PICK UP MY CLRNC IN THE AIR WHILE CIRCLING OVER THE ARPT. HIS REPLY WAS THAT HE WOULD BE EXPECTING ME AND THAT HE WOULD TRY TO HAVE MY CLRNC READY BY THE TIME I WAS AIRBORNE. I TOOK OFF AND CLBED WHILE CIRCLING OVER THE ARPT. UPON CALLING POTOMAC APCH, I WAS GIVE A XPONDER CODE. AFTER ESTABLISHING RADAR CONTACT, I WAS THEN GIVEN MY CLRNC. IT NOW OCCURS TO ME THAT THE CTLR'S TACIT APPROVAL (PRIOR TO LNDG) OF MY SUGGESTED PROC MAY NOT HAVE BEEN AN OFFICIAL CLRNC TO ENTER THE ADIZ PRIOR TO MY INITIAL RADIO CALL AFTER DEP. IN THE FUTURE, WHEN I AM ON SUCH A TRIP WITH A SHORT TIME ON THE GND AT MD31, I WILL BE SURE THAT I HAVE A DEP CLRNC BEFORE I LAND OR I WILL GET IT BY PHONE BEFORE TAKING OFF.
