Narrative:

I am an A300 captain based in ZZZ on international reserve. I was assigned an XA20 program for 08/mon/03, with a duty period of XA20 to XP59. Crew schedule called me at approximately XI35 on aug/mon/03 to procure a trip to ZZZZ, first officer, with a landing time of XS09. I asked the scheduler how I could do that if my program ended at XP59. I was informed that I was still legal to fly the international trip, as programs don't apply to flag operations. Air carrier X wants to have their cake and eat it too. You can be illegal to fly a 50NM trip, but legal to fly 4000 NM on and int'l trip.. This defies all attempts at logic. In the future when assigned a domestic program, I will consider it binding on international departures as well. In order to be rested at XA00 you must retire early which means you will probably rise early. Your body will tire regardless of where you are flying to. This dangerous loophole needs to be closed.

CREW SCHEDULE CALLED ME AT APPROX XI35 ON AUG/MON/03 TO PROCURE A TRIP TO ZZZZ, FO, WITH A LNDG TIME OF XS09. I ASKED THE SCHEDULER HOW I COULD DO THAT IF MY PROGRAM ENDED AT XP59. I WAS INFORMED THAT I WAS STILL LEGAL TO FLY THE INTL TRIP, AS PROGRAMS DON'T APPLY TO FLAG OPS. ACR X WANTS TO HAVE THEIR CAKE AND EAT IT TOO. YOU CAN BE ILLEGAL TO FLY A 50NM TRIP, BUT LEGAL TO FLY 4000 NM ON AND INT'L TRIP.. THIS DEFIES ALL ATTEMPTS AT LOGIC. IN THE FUTURE WHEN ASSIGNED A DOMESTIC PROGRAM, I WILL CONSIDER IT BINDING ON INTL DEPS AS WELL. IN ORDER TO BE RESTED AT XA00 YOU MUST RETIRE EARLY WHICH MEANS YOU WILL PROBABLY RISE EARLY. YOUR BODY WILL TIRE REGARDLESS OF WHERE YOU ARE FLYING TO. THIS DANGEROUS LOOPHOLE NEEDS TO BE CLOSED.
