Narrative:

Crew rest legality. After completing the second day of our sequence we had flown 8 hours and 45 mins within a period of 24 hours. According to far 121.481C we needed a rest period of 18 hours. When I called crew tracking to confirm our departure time for the following day I was told that we were leaving on schedule which was 12 hours 53 mins later. I spoke with the manager who informed me that the company had reinterpreted the far 121.481C and since we had a domestic leg during our 8 hours 45 mins of flying the rule did not apply. According to our manual, if there is disagreement as far as legality the manager will rule. I believe that the intent of the far 121.481C is to provide crew members with adequate rest. The first officer and myself flew 8 hours 45 mins within a 24 hour period/international or domestic we incur the same fatigue.

Title: CREW REST LEGALITIES ARE REINTERPRETED BY AN ACR USING DOMESTIC RULES WHEN THE FLT SEQUENCE IS BOTH A FLAG AND DOMESTIC OP IN ORDER TO REDUCE A REQUIRED REST PERIOD.

Narrative: CREW REST LEGALITY. AFTER COMPLETING THE SECOND DAY OF OUR SEQUENCE WE HAD FLOWN 8 HRS AND 45 MINS WITHIN A PERIOD OF 24 HRS. ACCORDING TO FAR 121.481C WE NEEDED A REST PERIOD OF 18 HRS. WHEN I CALLED CREW TRACKING TO CONFIRM OUR DEP TIME FOR THE FOLLOWING DAY I WAS TOLD THAT WE WERE LEAVING ON SCHEDULE WHICH WAS 12 HRS 53 MINS LATER. I SPOKE WITH THE MGR WHO INFORMED ME THAT THE COMPANY HAD REINTERPRETED THE FAR 121.481C AND SINCE WE HAD A DOMESTIC LEG DURING OUR 8 HRS 45 MINS OF FLYING THE RULE DID NOT APPLY. ACCORDING TO OUR MANUAL, IF THERE IS DISAGREEMENT AS FAR AS LEGALITY THE MGR WILL RULE. I BELIEVE THAT THE INTENT OF THE FAR 121.481C IS TO PROVIDE CREW MEMBERS WITH ADEQUATE REST. THE FO AND MYSELF FLEW 8 HRS 45 MINS WITHIN A 24 HR PERIOD/INTL OR DOMESTIC WE INCUR THE SAME FATIGUE.
