Narrative:

I rented an aircraft from a flight school for a local flight. After the uneventful flight, I noticed that the aircraft was 20 hours over its 100 hour required maintenance check. It is my understanding that exceeding this 100 hour maintenance check is in violation of 14CFR 91.409 because the aircraft was a rental and therefore 'for hire.' I asked the owner of the flight school about the 100 hour maintenance check and he stated that the 100 hour check does not have to be done due to the type of operation being flown. I believe that a better understanding of the far's by the GA community, as well as more emphasis on education, can prevent further recurrences.

Title: A CERTIFIED FLT INSTRUCTOR RPTS OPERATING A C172 WITH 20 HRS OVER THE 100 HR ANNUAL INSPECTION LIMITS.

Narrative: I RENTED AN ACFT FROM A FLT SCHOOL FOR A LCL FLT. AFTER THE UNEVENTFUL FLT, I NOTICED THAT THE ACFT WAS 20 HRS OVER ITS 100 HR REQUIRED MAINT CHK. IT IS MY UNDERSTANDING THAT EXCEEDING THIS 100 HR MAINT CHK IS IN VIOLATION OF 14CFR 91.409 BECAUSE THE ACFT WAS A RENTAL AND THEREFORE 'FOR HIRE.' I ASKED THE OWNER OF THE FLT SCHOOL ABOUT THE 100 HR MAINT CHK AND HE STATED THAT THE 100 HR CHK DOES NOT HAVE TO BE DONE DUE TO THE TYPE OF OP BEING FLOWN. I BELIEVE THAT A BETTER UNDERSTANDING OF THE FAR'S BY THE GA COMMUNITY, AS WELL AS MORE EMPHASIS ON EDUCATION, CAN PREVENT FURTHER RECURRENCES.
