Narrative:
#1 starter failure at gate. Maintenance could not fix. Mechanics sent on road trip from ZZZ1. Arrived several hours later. Aircraft fixed 9 hours later. Crew sat whole time in ZZZ operations. After maintenance done, mot and edct times approaching. During preflight snow began to fall. After coordination deice with ramp and clearance with dispatch and ATC, we boarded. During before start checklist, saw and felt gear pin, covered by coat. Normal taxi and takeoff. Gear failed to retract during climb. Returned to ZZZ. Inspection revealed gear pins removed and continued to ZZZ1. Callback conversation with reporter revealed the following information: the reporter stated the technicians sent into the station to replace the failed #1 engine starter installed the landing gear lock pins. The reporter said upon completion of the starter change the gear pins were not removed prior to dispatch. The reporter stated it is not done by the reporter if the procedures the technician followed required gear pins to be installed.

Title: AN EMBRAER ERJ-135 WAS DISPATCHED IN NON COMPLIANCE WITH MAIN AND NOSE LNDG GEAR PINS INSTALLED. RETURNED TO THE FIELD UNABLE TO RETRACT LNDG GEAR.
Narrative: #1 STARTER FAILURE AT GATE. MAINT COULD NOT FIX. MECHS SENT ON ROAD TRIP FROM ZZZ1. ARRIVED SEVERAL HRS LATER. ACFT FIXED 9 HRS LATER. CREW SAT WHOLE TIME IN ZZZ OPS. AFTER MAINT DONE, MOT AND EDCT TIMES APCHING. DURING PREFLT SNOW BEGAN TO FALL. AFTER COORD DEICE WITH RAMP AND CLRNC WITH DISPATCH AND ATC, WE BOARDED. DURING BEFORE START CHKLIST, SAW AND FELT GEAR PIN, COVERED BY COAT. NORMAL TAXI AND TKOF. GEAR FAILED TO RETRACT DURING CLB. RETURNED TO ZZZ. INSPECTION REVEALED GEAR PINS REMOVED AND CONTINUED TO ZZZ1. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THE RPTR STATED THE TECHNICIANS SENT INTO THE STATION TO REPLACE THE FAILED #1 ENG STARTER INSTALLED THE LNDG GEAR LOCK PINS. THE RPTR SAID UPON COMPLETION OF THE STARTER CHANGE THE GEAR PINS WERE NOT REMOVED PRIOR TO DISPATCH. THE RPTR STATED IT IS NOT DONE BY THE RPTR IF THE PROCS THE TECHNICIAN FOLLOWED REQUIRED GEAR PINS TO BE INSTALLED.
