Narrative:
At XA50 I tried to pick up an IFR clearance to bwi from opf. Tower advised me that they would be closing at XB00 and that I should pick up the clearance from mia when airborne. After departure, the captain climbed to 3000 ft MSL on a 090 degree heading. I called miami departure to pick up the clearance and was given a transponder code, altitude and heading to maintain. The controller then gave me a clearance to bwi that I could not accept, because the aircraft was not equipped for that route of flight. The controller then got rude and told me that he can't give me a full clearance and that I should have done this on the ground. I told him that I tried to pick up the clearance from opf, but the tower did not give it to me because they were closing. The controller then told me to turn to the south and then to the west over mia. After the turn, he gave me the clearance that was filed. However, there was an FAA examiner on the flight with us and he did not like the unprofessional attitude of the controller. The FAA examiner requested the controller's operating initials. The controller gave me a contact number to give to the FAA examiner. The FAA examiner called us a couple of days later and told us that the controller was filing a pilot deviation report because we entered class B airspace without permission.
Original NASA ASRS Text
Title: IFR B727 DEP FROM OPF IS TOLD BY ATC TO PICK UP CLRNC FROM MIA TRACON AFTER DEP AND ALLEGEDLY ENTERED CLASS B WITHOUT CLRNC.
Narrative: AT XA50 I TRIED TO PICK UP AN IFR CLRNC TO BWI FROM OPF. TWR ADVISED ME THAT THEY WOULD BE CLOSING AT XB00 AND THAT I SHOULD PICK UP THE CLRNC FROM MIA WHEN AIRBORNE. AFTER DEP, THE CAPT CLBED TO 3000 FT MSL ON A 090 DEG HDG. I CALLED MIAMI DEP TO PICK UP THE CLRNC AND WAS GIVEN A XPONDER CODE, ALT AND HDG TO MAINTAIN. THE CTLR THEN GAVE ME A CLRNC TO BWI THAT I COULD NOT ACCEPT, BECAUSE THE ACFT WAS NOT EQUIPPED FOR THAT RTE OF FLT. THE CTLR THEN GOT RUDE AND TOLD ME THAT HE CAN'T GIVE ME A FULL CLRNC AND THAT I SHOULD HAVE DONE THIS ON THE GND. I TOLD HIM THAT I TRIED TO PICK UP THE CLRNC FROM OPF, BUT THE TWR DID NOT GIVE IT TO ME BECAUSE THEY WERE CLOSING. THE CTLR THEN TOLD ME TO TURN TO THE S AND THEN TO THE W OVER MIA. AFTER THE TURN, HE GAVE ME THE CLRNC THAT WAS FILED. HOWEVER, THERE WAS AN FAA EXAMINER ON THE FLT WITH US AND HE DID NOT LIKE THE UNPROFESSIONAL ATTITUDE OF THE CTLR. THE FAA EXAMINER REQUESTED THE CTLR'S OPERATING INITIALS. THE CTLR GAVE ME A CONTACT NUMBER TO GIVE TO THE FAA EXAMINER. THE FAA EXAMINER CALLED US A COUPLE OF DAYS LATER AND TOLD US THAT THE CTLR WAS FILING A PLTDEV RPT BECAUSE WE ENTERED CLASS B AIRSPACE WITHOUT PERMISSION.
