Narrative:
Made an uneventful VFR/ILS approach to ewr runway 4R. Was surprised during the flare that the 90 degrees, 15 KT right crosswind became quite turbulent. Had to work at the landing and landed a little long for me. During landing rollout and while in thrust reverse and braking (on a rough runway and crosswind) tower gave us clearing instructions. My first officer read back the clearance. I was not concentrating on tower's instructions due to my high workload at the time of completing the landing. I remember hearing the tower and the first officer say 'clearing left,' maybe another left. I turned off at high speed taxiway left, then left on taxiway Y, I called for the 'after landing' check and proceeded forward on taxiway Y. Nearing the end of runway 4L I asked the first officer if tower had cleared us to cross runway 4L. He looked up and said 'yes.' I looked left and down runway 4L and noticed an aircraft in position. It appeared stationary at (10000 ft away) I turned on my strobe lights as it is my habit whenever crossing an active runway, pwred up some and scooted across runway 4L on taxiway Y.after we cleared runway 4L as we turned left onto taxiway right, tower called and said we had missed taxiway P. The first officer and I had a brief discussion. He rogered that and we received taxi instructions to the gate. We were not cleared to cross runway 4L it turned out. Also, the aircraft I thought was in position had just begun his takeoff roll. I was wrong to cross runway 4L without hearing and understanding the tower clearance. The tower should not have given the clearance while we were in that stage of rollout.the first officer should not have read it back. He does not know why he responded to my question in the affirmative. Safe separation had never been compromised (verified by ewr tower in their report to me 7 days later). No deviation by departing aircraft was taken. No tower action was taken. I do not think the controller saw until we were clear. Arrival at ewr was the end of a 10 hour work day. Fatigue may have factored in some. We both hit 'sinkers' en route to ewr. I had water. First officer had coffee. We both seemed to perk up though.

THE TWR SHOULD NOT HAVE GIVEN THE CLRNC WHILE WE WERE IN THAT STAGE OF ROLLOUT.THE FO SHOULD NOT HAVE READ IT BACK. HE DOES NOT KNOW WHY HE RESPONDED TO MY QUESTION IN THE AFFIRMATIVE. SAFE SEPARATION HAD NEVER BEEN COMPROMISED (VERIFIED BY EWR TWR IN THEIR RPT TO ME 7 DAYS LATER). NO DEV BY DEPARTING ACFT WAS TAKEN. NO TWR ACTION WAS TAKEN. I DO NOT THINK THE CTLR SAW UNTIL WE WERE CLR. ARR AT EWR WAS THE END OF A 10 HR WORK DAY. FATIGUE MAY HAVE FACTORED IN SOME. WE BOTH HIT 'SINKERS' ENRTE TO EWR. I HAD WATER. FO HAD COFFEE.
