Narrative:
After takeoff in ZZZ, the gear would not retract. It became apparent after examining checklists and talking to maintenance control that the gear was going to remain down. We returned for a normal landing in ZZZ with all indications normal. When a mechanic checked the gear, he informed us that the gear bypass was open. Assuming the gear bypass was left open by someone, it is possible it was left open by maintenance during their service check the night before. Since it was dark and rainy for this early morning departure, it may have been missed during walkarounds.
