Narrative:

We departed late (passenger delay) that evening putting us behind on schedule. We knew that when we arrived in mdw, we would still have to park, get fuel, and get going as soon as possible because our next destination airport had a curfew. When coming in to land, we were asked to land on a different runway. No problem, just increases our taxi in time. We parked, fueled, and were ready to get going. We reviewed the departure procedure for the runway we thought we were going to get and then got taxi instructions to a different runway. I asked the PNF to take a look at the airport diagram to get me out to runway 31C. We both reviewed the SID for runway 31C. In our 'let's go' mode, we briefed no turns until 1300 ft. We arrived and held short (#1 for takeoff) on the south side of runway 31C. We observed 4-5 airplanes depart runway 31C from the north side. The PNF then asked the controller 'what is our sequence?' the controller replied 'standby.' we continued to situation and watch another 4-5 airplanes depart. The PNF asked again, 'what is our sequence?' the controller rudely replied 'N123, if you haven't noticed, there are a lot of airplanes out there!' we were released to take off shortly after that. Now we are running very late, dealing with a rude controller, and not going to make our curfew at our next destination. The amount of stuff on our plate was growing rapidly. In the midst of all of this, we forgot to brief the part of the SID 'complete the turn by 4 DME cgt VOR.' on climb out at 1300 ft, I started the turn and the controller states to us 'start your turn so you don't bust the SID.' I increased the bank, leveled at 2000 ft on the appropriate heading. I don't think I broke the SID. There were no TA's or any other advisories. I do take responsibility for not noticing the 4 DME turn radius on the SID that evening. After leaving their airspace that evening, we reviewed everything that happened and agreed to double and triple check everything else we were doing. We didn't want to keep the chain growing! Supplemental information from acn 635165: we were scheduled to leave, arrive and depart before the curfew went into effect. Scheduled time to get to our final destination, XA00. Setting up possible mistakes just because we're tired. Flying partner needed to get current again. Was barely legal within 90 days, so not quite at the top of his game. Worried sick about telling our boss. Wondering how he would handle the fact that we were running late and needed to possibly change our itinerary to accommodate the curfew. Suddenly looking at not getting home and worried about who was going to take care of the kids in the morning. The tower controller that evening was nasty. I asked my partner, 'you have the radios?' I went to ground and asked for the tower phone number. Rang the cabin attendant up and explained that, hey look, I'm just trying to figure out my sequence for departure because I have a curfew I need to make. That's all! He responded by telling me that I was third for departure. I told him great and that's all I needed. I don't know if we broke the distance in the SID or not since we were busy doing a 45 degree banked turn at night and making sure we leveled at 2000 ft. Just fly the plane, right? The controller never said we were an issue or conflict to anyone. He just yelled and was still just a bit cranky. I don't think the size or vocal characteristics is relevant to how this controller should do his job. It was evident to me that he liked neither, the cpr jet, or the voice characteristics. I take responsibility that I didn't read the SID closely enough, nor did I delegate and ask the PF to double check the SID again while I was swamped with calls and dealings with our dispatcher, tower and concern over our boss and family.

Title: POSSIBLE SID DME OVERSHOOT DURING A NIGHT OP BY A STRESSED H25B FLT CREW 4 MI NW OF MDW.

Narrative: WE DEPARTED LATE (PAX DELAY) THAT EVENING PUTTING US BEHIND ON SCHEDULE. WE KNEW THAT WHEN WE ARRIVED IN MDW, WE WOULD STILL HAVE TO PARK, GET FUEL, AND GET GOING ASAP BECAUSE OUR NEXT DEST ARPT HAD A CURFEW. WHEN COMING IN TO LAND, WE WERE ASKED TO LAND ON A DIFFERENT RWY. NO PROB, JUST INCREASES OUR TAXI IN TIME. WE PARKED, FUELED, AND WERE READY TO GET GOING. WE REVIEWED THE DEP PROC FOR THE RWY WE THOUGHT WE WERE GOING TO GET AND THEN GOT TAXI INSTRUCTIONS TO A DIFFERENT RWY. I ASKED THE PNF TO TAKE A LOOK AT THE ARPT DIAGRAM TO GET ME OUT TO RWY 31C. WE BOTH REVIEWED THE SID FOR RWY 31C. IN OUR 'LET'S GO' MODE, WE BRIEFED NO TURNS UNTIL 1300 FT. WE ARRIVED AND HELD SHORT (#1 FOR TKOF) ON THE S SIDE OF RWY 31C. WE OBSERVED 4-5 AIRPLANES DEPART RWY 31C FROM THE N SIDE. THE PNF THEN ASKED THE CTLR 'WHAT IS OUR SEQUENCE?' THE CTLR REPLIED 'STANDBY.' WE CONTINUED TO SIT AND WATCH ANOTHER 4-5 AIRPLANES DEPART. THE PNF ASKED AGAIN, 'WHAT IS OUR SEQUENCE?' THE CTLR RUDELY REPLIED 'N123, IF YOU HAVEN'T NOTICED, THERE ARE A LOT OF AIRPLANES OUT THERE!' WE WERE RELEASED TO TAKE OFF SHORTLY AFTER THAT. NOW WE ARE RUNNING VERY LATE, DEALING WITH A RUDE CTLR, AND NOT GOING TO MAKE OUR CURFEW AT OUR NEXT DEST. THE AMOUNT OF STUFF ON OUR PLATE WAS GROWING RAPIDLY. IN THE MIDST OF ALL OF THIS, WE FORGOT TO BRIEF THE PART OF THE SID 'COMPLETE THE TURN BY 4 DME CGT VOR.' ON CLB OUT AT 1300 FT, I STARTED THE TURN AND THE CTLR STATES TO US 'START YOUR TURN SO YOU DON'T BUST THE SID.' I INCREASED THE BANK, LEVELED AT 2000 FT ON THE APPROPRIATE HDG. I DON'T THINK I BROKE THE SID. THERE WERE NO TA'S OR ANY OTHER ADVISORIES. I DO TAKE RESPONSIBILITY FOR NOT NOTICING THE 4 DME TURN RADIUS ON THE SID THAT EVENING. AFTER LEAVING THEIR AIRSPACE THAT EVENING, WE REVIEWED EVERYTHING THAT HAPPENED AND AGREED TO DOUBLE AND TRIPLE CHK EVERYTHING ELSE WE WERE DOING. WE DIDN'T WANT TO KEEP THE CHAIN GROWING! SUPPLEMENTAL INFO FROM ACN 635165: WE WERE SCHEDULED TO LEAVE, ARRIVE AND DEPART BEFORE THE CURFEW WENT INTO EFFECT. SCHEDULED TIME TO GET TO OUR FINAL DEST, XA00. THE TWR CTLR THAT EVENING WAS NASTY. I ASKED MY PARTNER, 'YOU HAVE THE RADIOS?' I WENT TO GND AND ASKED FOR THE TWR PHONE NUMBER. RANG THE CAB UP AND EXPLAINED THAT, HEY LOOK, I'M JUST TRYING TO FIGURE OUT MY SEQUENCE FOR DEP BECAUSE I HAVE A CURFEW I NEED TO MAKE. THAT'S ALL! HE RESPONDED BY TELLING ME THAT I WAS THIRD FOR DEP. I TOLD HIM GREAT AND THAT'S ALL I NEEDED. I DON'T KNOW IF WE BROKE THE DISTANCE IN THE SID OR NOT SINCE WE WERE BUSY DOING A 45 DEG BANKED TURN AT NIGHT AND MAKING SURE WE LEVELED AT 2000 FT. JUST FLY THE PLANE, RIGHT? THE CTLR NEVER SAID WE WERE AN ISSUE OR CONFLICT TO ANYONE. HE JUST YELLED AND WAS STILL JUST A BIT CRANKY. I DON'T THINK THE SIZE OR VOCAL CHARACTERISTICS IS RELEVANT TO HOW THIS CTLR SHOULD DO HIS JOB. IT WAS EVIDENT TO ME THAT HE LIKED NEITHER, THE CPR JET, OR THE VOICE CHARACTERISTICS. I TAKE RESPONSIBILITY THAT I DIDN'T READ THE SID CLOSELY ENOUGH, NOR DID I DELEGATE AND ASK THE PF TO DOUBLE CHK THE SID AGAIN WHILE I WAS SWAMPED WITH CALLS AND DEALINGS WITH OUR DISPATCHER, TWR AND CONCERN OVER OUR BOSS AND FAMILY.
