Narrative:
On climb out from jfk after VNAV; flaps 5 degrees; climb power; jfk tower handed us off to ny departure. I changed frequency; however the radio did not switch channels for some reason. When I checked in with departure I was still on tower frequency; I checked the correct frequency and flipped the xfer switch back and forth and still remained on tower frequency. I then reselected departure frequency on our other communication radio and finally got departure control. During this short time my attention was diverted from the aircraft and PF. We had exceeded our flap 5 maximum speed by about 20 KTS. The flaps retracted without any problem. I did not feel like there was any structural problem; so we continued onto ZZZ. I advised dispatch and maintenance of the overspd and that I was continuing on to ZZZ.

Title: B757 FLT CREW REPORTS DISTRACTION WITH RADIOS DEPARTING JFK THAT CAUSES A FLAP OVERSPEED.
Narrative: ON CLBOUT FROM JFK AFTER VNAV; FLAPS 5 DEGS; CLB PWR; JFK TWR HANDED US OFF TO NY DEP. I CHANGED FREQ; HOWEVER THE RADIO DID NOT SWITCH CHANNELS FOR SOME REASON. WHEN I CHKED IN WITH DEP I WAS STILL ON TWR FREQ; I CHKED THE CORRECT FREQ AND FLIPPED THE XFER SWITCH BACK AND FORTH AND STILL REMAINED ON TWR FREQ. I THEN RESELECTED DEP FREQ ON OUR OTHER COM RADIO AND FINALLY GOT DEP CTL. DURING THIS SHORT TIME MY ATTN WAS DIVERTED FROM THE ACFT AND PF. WE HAD EXCEEDED OUR FLAP 5 MAX SPD BY ABOUT 20 KTS. THE FLAPS RETRACTED WITHOUT ANY PROB. I DID NOT FEEL LIKE THERE WAS ANY STRUCTURAL PROB; SO WE CONTINUED ONTO ZZZ. I ADVISED DISPATCH AND MAINT OF THE OVERSPD AND THAT I WAS CONTINUING ON TO ZZZ.
