Narrative:
While descending in to vny; we were cleared to 5000 ft MSL heading west. While level; a turbo commander departed vny and made a left turn directly in front of us northbound. He told socal that he was climbing to 8500 ft VFR. I realized we were close and pulled the TCAS display up to look for him. As I did; the TCAS gave us a TA. He was about 400 ft below us and climbing. Socal told the commander about us and at the same time we got an RA commanding a climb. We began our climb and I told socal we were climbing. Socal said the commander had us in sight. I told him that it did not matter; we had climbed because of the TCAS alert. The commander passed within 100 ft of us according to the TCAS. We descended to 5000 ft and I reported vny in sight and we were promptly cleared for the visual approach and handed off to vny tower. I don't believe that vny tower was told about the VFR departure. In my opinion VFR should not be allowed in areas where there is as much traffic as the los angeles area. It's just too dangerous!

Title: A SMALL JET DESCENDING INTO VNY HAS A NMAC WITH AN ACFT AT 5000 FT AS IT DEPARTED VFR CLBING. THE VFR TFC REPORTED THE JET IN SIGHT BUT DID NOT AVOID IT.
Narrative: WHILE DSNDING IN TO VNY; WE WERE CLRED TO 5000 FT MSL HEADING W. WHILE LEVEL; A TURBO COMMANDER DEPARTED VNY AND MADE A L TURN DIRECTLY IN FRONT OF US NBOUND. HE TOLD SOCAL THAT HE WAS CLBING TO 8500 FT VFR. I REALIZED WE WERE CLOSE AND PULLED THE TCAS DISPLAY UP TO LOOK FOR HIM. AS I DID; THE TCAS GAVE US A TA. HE WAS ABOUT 400 FT BELOW US AND CLBING. SOCAL TOLD THE COMMANDER ABOUT US AND AT THE SAME TIME WE GOT AN RA COMMANDING A CLB. WE BEGAN OUR CLB AND I TOLD SOCAL WE WERE CLBING. SOCAL SAID THE COMMANDER HAD US IN SIGHT. I TOLD HIM THAT IT DID NOT MATTER; WE HAD CLBED BECAUSE OF THE TCAS ALERT. THE COMMANDER PASSED WITHIN 100 FT OF US ACCORDING TO THE TCAS. IN MY OPINION VFR SHOULD NOT BE ALLOWED IN AREAS WHERE THERE IS AS MUCH TFC AS THE LOS ANGELES AREA. IT'S JUST TOO DANGEROUS!
