Narrative:
While on climbout after taking off out of philadelphia airport, departure queried our flight as to whether we were maintaining 3000'. At this time we were climbing out of 4000' enroute to 5000' as per our departure SID. We stated to the departure controller that we were out of 4000' and had been given no restriction to level at 3000'. The controller then stated that 'the tower was supposed to have given you (us) the 3000' restriction'. We stated that he hadn't nor had we acknowledged any such restriction. Nothing further was stated and we descended to 3000' after asking the controller if he still wished us at that altitude. This, once again, clearly states the need for better and more closely guarded communications between ATC and pilots.

Title: ATCT LCL CTLR FAILED TO GIVE ALT RESTRICTION TO ACR MLG WITH TKOF RELEASE CAUSING ALT BUST.
Narrative: WHILE ON CLIMBOUT AFTER TAKING OFF OUT OF PHILADELPHIA ARPT, DEP QUERIED OUR FLT AS TO WHETHER WE WERE MAINTAINING 3000'. AT THIS TIME WE WERE CLIMBING OUT OF 4000' ENROUTE TO 5000' AS PER OUR DEP SID. WE STATED TO THE DEP CTLR THAT WE WERE OUT OF 4000' AND HAD BEEN GIVEN NO RESTRICTION TO LEVEL AT 3000'. THE CTLR THEN STATED THAT 'THE TWR WAS SUPPOSED TO HAVE GIVEN YOU (US) THE 3000' RESTRICTION'. WE STATED THAT HE HADN'T NOR HAD WE ACKNOWLEDGED ANY SUCH RESTRICTION. NOTHING FURTHER WAS STATED AND WE DESCENDED TO 3000' AFTER ASKING THE CTLR IF HE STILL WISHED US AT THAT ALT. THIS, ONCE AGAIN, CLEARLY STATES THE NEED FOR BETTER AND MORE CLOSELY GUARDED COMMUNICATIONS BETWEEN ATC AND PLTS.
