Narrative:
As we were descending through 7400' we saw an small aircraft go from our right to left in our windshield. He was at our altitude and approximately 300' in front of us. We asked the controller what he showed, he said nothing and a minute later said that he then identified the traffic as VFR. We were descending as assigned to a lower assigned altitude. We advised the approach that we were going to file a report, he told us to call XXXX. We were cleared to cross broadway at 7000 -- our radio frequency at the time 127.6. Callback conversation with reporter revealed following information: reporter advised the captain made the call to the controller and he was not aware of the inoperative was not sure if the small aircraft had a transponder. Convinced all aircraft were legal in the operation. Assumes the captain filed a report with company and that the information was forwarded to FAA.

Title: DESCENDING ENCOUNTERED SMA ACFT OPERATING VFR ON NE HEADING. NO TIME FOR EVASIVE ACTION.
Narrative: AS WE WERE DSNDING THROUGH 7400' WE SAW AN SMA GO FROM OUR R TO L IN OUR WINDSHIELD. HE WAS AT OUR ALT AND APPROX 300' IN FRONT OF US. WE ASKED THE CTLR WHAT HE SHOWED, HE SAID NOTHING AND A MINUTE LATER SAID THAT HE THEN IDENTIFIED THE TFC AS VFR. WE WERE DSNDING AS ASSIGNED TO A LOWER ASSIGNED ALT. WE ADVISED THE APCH THAT WE WERE GOING TO FILE A RPT, HE TOLD US TO CALL XXXX. WE WERE CLRED TO CROSS BROADWAY AT 7000 -- OUR RADIO FREQ AT THE TIME 127.6. CALLBACK CONVERSATION WITH RPTR REVEALED FOLLOWING INFO: RPTR ADVISED THE CAPT MADE THE CALL TO THE CTLR AND HE WAS NOT AWARE OF THE INOP WAS NOT SURE IF THE SMA HAD A TRANSPONDER. CONVINCED ALL ACFT WERE LEGAL IN THE OPERATION. ASSUMES THE CAPT FILED A RPT WITH COMPANY AND THAT THE INFO WAS FORWARDED TO FAA.
