Narrative:
Flying into san on the cardi arrival, after going over to approach control, we were cleared to a southeasterly heading to descend to 9000' and slow to 210 KTS. On a constant heading and descending closed throttles and slowing, I called traffic at 1 O'clock, northbound. A few seconds later he stopped turning and appeared to be coming at us, but with adequate vertical sep. The target appeared as a single red beacon. The first officer said he could not see the target. I responded with, 'he's behind your windshield post.' the first officer now spotted the traffic. A few seconds later the vertical sep diminished rapidly. I called to the first officer to 'push it down.' he responded and the military aircraft passed over us. Visual vertical sep did not appear critical (in the dark), but I could hear his engines. This prompted me to ask approach about the traffic. He said that it was a military jet returning to miramar cleared to 15000'. On the ground the watch supervisor said the military jet was indicating 325 KTS and was at 14100' and we were at 13700'. The military jet had some 'hung ordinance' and was returning to base under emergency conditions.

Title: MIL-FGT DESCENDED BELOW ASSIGNED ALT RESULTING IN A NEAR MIDAIR COLLISION WITH ACR-MLG.
Narrative: FLYING INTO SAN ON THE CARDI ARR, AFTER GOING OVER TO APCH CTL, WE WERE CLRED TO A SOUTHEASTERLY HDG TO DSND TO 9000' AND SLOW TO 210 KTS. ON A CONSTANT HDG AND DSNDING CLOSED THROTTLES AND SLOWING, I CALLED TFC AT 1 O'CLOCK, NBND. A FEW SECS LATER HE STOPPED TURNING AND APPEARED TO BE COMING AT US, BUT WITH ADEQUATE VERT SEP. THE TARGET APPEARED AS A SINGLE RED BEACON. THE F/O SAID HE COULD NOT SEE THE TARGET. I RESPONDED WITH, 'HE'S BEHIND YOUR WINDSHIELD POST.' THE F/O NOW SPOTTED THE TFC. A FEW SECS LATER THE VERT SEP DIMINISHED RAPIDLY. I CALLED TO THE F/O TO 'PUSH IT DOWN.' HE RESPONDED AND THE MIL ACFT PASSED OVER US. VISUAL VERT SEP DID NOT APPEAR CRITICAL (IN THE DARK), BUT I COULD HEAR HIS ENGS. THIS PROMPTED ME TO ASK APCH ABOUT THE TFC. HE SAID THAT IT WAS A MIL JET RETURNING TO MIRAMAR CLRED TO 15000'. ON THE GND THE WATCH SUPVR SAID THE MIL JET WAS INDICATING 325 KTS AND WAS AT 14100' AND WE WERE AT 13700'. THE MIL JET HAD SOME 'HUNG ORDINANCE' AND WAS RETURNING TO BASE UNDER EMER CONDITIONS.
