Narrative:

Cargo not secured: separate NASA report filed on this. Cargo front half was in fact tied down and rear half was so bulky it could not shift. In my opinion the cargo was secured well enough and that is commencerate with operations manual far's. Brace on seat ad note: ad 83-21-06 ri--there was no way for me to know that this ad had not been complied with. The aircraft had just come out of a 100 hour inspection. ELT battery overdue: the battery showed ok on the aircraft placard and the operations log book. I had no way of knowing otherwise. This complied with airworthiness check required by operations manual and regulations. No record of ELT or fire bottle inspection. Once again the aircraft just came out of a 100 hour inspection. Altimeter not calibrated: the yellow tag for altimeter was found 2 days later and it was in fact ok. Supplemental information from acn 97634 (previously mentioned report): the inspector wrote a letter to company saying I did not have the cargo secured. Front portion had been secured with a net to prevent shifting. The fact that the cargo was so bulky prevented the use of straps in the rear portion and also precluded the possibility of shifting. Callback conversation with reporter revealed the following: reporter has not responded to letter received from FAA. Has discussed verbally with company and is waiting for further action from FAA. WX conditions for the flight were low stratus ceiling with severe smooth flying conditions. Company directive leaves it up to the captain to decide if the cargo is adequately secured.

CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR HAS NOT RESPONDED TO LETTER RECEIVED FROM FAA. HAS DISCUSSED VERBALLY WITH COMPANY AND IS WAITING FOR FURTHER ACTION FROM FAA. WX CONDITIONS FOR THE FLT WERE LOW STRATUS CEILING WITH SEVERE SMOOTH FLYING CONDITIONS. COMPANY DIRECTIVE LEAVES IT UP TO THE CAPT TO DECIDE IF THE CARGO IS ADEQUATELY SECURED.
