Narrative:
1/89 VFR flight toward sacramento from hwd. This is not an admission of guilt, but a commentary on airport tower zeal with regards to the oak arsa. Takeoff from hwd with a crosswind clearance from runway 28R heading east to livermore. Climb to 1400' MSL with DME/VOR set for sfo VOR 115.8 to give DME indication of 15 NM or more to clear oak arsa as per chart. At 19 DME started climb to 1900' MSL (070 degrees from sfo VOR) hwd tower asked for altitude when at 19 DME. Responded, 'climbing to 1900' MSL.' was told that I was into arsa. 'Descend to 1400,' was instruction. Complied as per hwd tower's instruction. At 21 DME was told to continue climb and frequency change was approved. Continued climb to 3500' MSL toward livermore, but flew over highway and east hills at 2000' MSL, not as preferred by pilot's choice. Encountered some turbulence close to hill crest. Note: pilot never penetrated oak arsa. With VOR on sfo reading 070 degrees from at more than 15 DME, was well outside arsa (and even sfo TCA).
