Narrative:
Shuttle departed lga, whitestone climb, lga approach control advised turn left 040 degrees climb to 12000'. Shortly thereafter lga approach control advised radar indicated we were above our assigned altitude of 8000'. Traffic 10 O'clock, 3 mi, at 9000'. We advised traffic in sight and returned to 8000'. Traffic passed and we continued on course west/O further incident. Neither the first officer nor myself heard nor acknowledged a clearance to 8000', 12000' last received. Either short stop clearance was not given by ATC or clearance was blocked by striking company pilots or other sympathy pilots. Since 3/thur/89 company radio xmissions are continually blocked all frequency on a daily basis, possibly by strikers with trans-receivers in airport terminals in lga, bos and dca.

Title: ACR MLG ALT DEVIATION OVERSHOT DURING SID FROM LGA. REPORTER SAYS THEY NEVER HEARD THE AMENDED CLRNC AND SPECULATES IT WAS BLOCKED BY ASSOCIATION PLTS INVOLVED IN A WORK ACTION.
Narrative: SHUTTLE DEPARTED LGA, WHITESTONE CLB, LGA APCH CTL ADVISED TURN LEFT 040 DEGS CLB TO 12000'. SHORTLY THEREAFTER LGA APCH CTL ADVISED RADAR INDICATED WE WERE ABOVE OUR ASSIGNED ALT OF 8000'. TFC 10 O'CLOCK, 3 MI, AT 9000'. WE ADVISED TFC IN SIGHT AND RETURNED TO 8000'. TFC PASSED AND WE CONTINUED ON COURSE W/O FURTHER INCIDENT. NEITHER THE F/O NOR MYSELF HEARD NOR ACKNOWLEDGED A CLRNC TO 8000', 12000' LAST RECEIVED. EITHER SHORT STOP CLRNC WAS NOT GIVEN BY ATC OR CLRNC WAS BLOCKED BY STRIKING COMPANY PLTS OR OTHER SYMPATHY PLTS. SINCE 3/THUR/89 COMPANY RADIO XMISSIONS ARE CONTINUALLY BLOCKED ALL FREQ ON A DAILY BASIS, POSSIBLY BY STRIKERS WITH TRANS-RECEIVERS IN ARPT TERMINALS IN LGA, BOS AND DCA.
