Narrative:
I filed a round robin flight from frg-hvn-fok-frg for a cfiai flight test. During taxi, we were informed there was no record of our plan in the computer. The ground controller suggested we depart VFR and get clearance once airborne. The examiner flew to hvn. ATC informed us our transponder was not working and asked us to recycle it. We were cleared for the ILS 2 circle to land (by approach) on runway 20 east of the airport. The examiner executed a missed approach, and tower asked why. The examiner told me to ask if we weren't cleared round robin, to which tower replied we were cleared to land. We were then issued a hold at the madison VOR, which we remained in for approximately 10 mins with the examiner still flying. During the hold, ATC asked us to climb from 3000 to 5000' because they weren't receiving our transponder, and asked us to report directly over the VOR, which we did. ATC then cleared us to the deer park VOR to proceed back to frg. The examiner wanted an approach into fok first, so we asked for one (at this time I would have preferred returning to frg since our transponder was not working), but the examiner wanted the approach. ATC informed us we were cleared to deer park and that they couldn't accommodate an approach at that time. The examiner then had me ask for a full stop at fok. ATC assigned us a heading and altitude and then to the hto VOR and to expect the ILS 24 at fok. At this time we had a problem transmitting and receiving on our radio for a minute or so. I then got established on the approach and ATC queries whether we had the proper altimeter setting which we did. Just prior to my reaching the decision height, the examiner takes the controls and executes a climbing left turn. I questioned him bout this and he told me 'we aren't landing'. We then asked ATC for a VOR approach into shirley (by now I am totally amazed that he would even ask for another approach since we had been having equipment problems). ATC informed us they were unable to accommodate us and to remain clear of the arsa and return VFR to frg. Then we were told to call ATC upon landing.

ATC ASSIGNED US A HDG AND ALT AND THEN TO THE HTO VOR AND TO EXPECT THE ILS 24 AT FOK. AT THIS TIME WE HAD A PROBLEM XMITTING AND RECEIVING ON OUR RADIO FOR A MINUTE OR SO. I THEN GOT ESTABLISHED ON THE APCH AND ATC QUERIES WHETHER WE HAD THE PROPER ALTIMETER SETTING WHICH WE DID. JUST PRIOR TO MY REACHING THE DECISION HEIGHT, THE EXAMINER TAKES THE CONTROLS AND EXECUTES A CLIMBING LEFT TURN. I QUESTIONED HIM BOUT THIS AND HE TOLD ME 'WE AREN'T LNDG'. WE THEN ASKED ATC FOR A VOR APCH INTO SHIRLEY (BY NOW I AM TOTALLY AMAZED THAT HE WOULD EVEN ASK FOR ANOTHER APCH SINCE WE HAD BEEN HAVING EQUIPMENT PROBLEMS). ATC INFORMED US THEY WERE UNABLE TO ACCOMMODATE US AND TO REMAIN CLEAR OF THE ARSA AND RETURN VFR TO FRG. THEN WE WERE TOLD TO CALL ATC UPON LNDG.
