Narrative:

Depart sjc runway 30L loupe six departure after being established on the 120 heading departure called and said when able turn so as to cross the VOR at 12,000, expect higher crossing the VOR. Our original clearance was the loupe six departure to maintain FL230. The first officer was flying and after crossing the VOR at 12,000 he maintained 12,000 waiting for clearance for higher. About 3 mi past the VOR I said we'd better climb to 14,000. He said he was waiting for clearance for higher. At that time I called departure and asked if we were cleared higher. Departure replied I think you should be at 14,000 8 mi north. We started our climb and crossed 14,000 about 12 mi north. I think the problem arose when departure said expect higher after passing the VOR. They apparently meant higher than 230 and the first officer thought they meant higher than 12,000. The time taken to question the clearance and the distance to climb to 14,000 was the reason we didn't make the 14,000 crossing. I think the loupe six departure in general is unsafe due to all the restrictions making it nearly impossible to maintain a visual lookout for other aircraft.

Title: ACR MLG FLT CREW DOES NOT UNDERSTAND THE RESTRICTIONS AND REQUIREMENTS OF THE LOUPE SIX DEP FROM SJC, FAILS TO MEET 14,000' CROSSING RESTRICTION 8 MILES NORTH OF THE SJC VOR.

Narrative: DEPART SJC RWY 30L LOUPE SIX DEP AFTER BEING ESTABLISHED ON THE 120 HDG DEP CALLED AND SAID WHEN ABLE TURN SO AS TO CROSS THE VOR AT 12,000, EXPECT HIGHER XING THE VOR. OUR ORIGINAL CLRNC WAS THE LOUPE SIX DEP TO MAINTAIN FL230. THE F/O WAS FLYING AND AFTER XING THE VOR AT 12,000 HE MAINTAINED 12,000 WAITING FOR CLRNC FOR HIGHER. ABOUT 3 MI PAST THE VOR I SAID WE'D BETTER CLIMB TO 14,000. HE SAID HE WAS WAITING FOR CLRNC FOR HIGHER. AT THAT TIME I CALLED DEP AND ASKED IF WE WERE CLRED HIGHER. DEP REPLIED I THINK YOU SHOULD BE AT 14,000 8 MI N. WE STARTED OUR CLIMB AND CROSSED 14,000 ABOUT 12 MI N. I THINK THE PROBLEM AROSE WHEN DEP SAID EXPECT HIGHER AFTER PASSING THE VOR. THEY APPARENTLY MEANT HIGHER THAN 230 AND THE F/O THOUGHT THEY MEANT HIGHER THAN 12,000. THE TIME TAKEN TO QUESTION THE CLRNC AND THE DISTANCE TO CLIMB TO 14,000 WAS THE REASON WE DIDN'T MAKE THE 14,000 XING. I THINK THE LOUPE SIX DEP IN GENERAL IS UNSAFE DUE TO ALL THE RESTRICTIONS MAKING IT NEARLY IMPOSSIBLE TO MAINTAIN A VISUAL LOOKOUT FOR OTHER ACFT.
