Narrative:
On assigned runway heading was climbing out to the practice area westbound from publication. Tower notified me that an aircraft was at 2 o'clock 3-5 miles away circling north of my position. Tower informed me that the aircraft would remain in that position. I looked; saw the aircraft and stated 'contact.' within a minute; said aircraft had proceeded south on an intercepting course with me (I did not know this). All of the sudden the aircraft was seen in my glare shield at about a 1:30 position; and proceeding on a collision course with me. I exchanged flight controls with the student after stating 'I have the flight controls' and executed a diving maneuver under the aircraft. I informed the tower that the aircraft had not remained where they said it was supposed to be. Later; (returning to the airport for a landing) said aircraft was seen about 1000 feet above the crosswind leg at publication still maneuvering. I told the tower and they said he was doing a survey and was not a factor.I don't believe letting an aircraft doing 'surveys' should be allowed to interfere with an active traffic pattern.

Title: Instructor pilot reported departing PUB for the training area west of the airport when ATC reported an aircraft orbiting north of their path. As they climbed the other aircraft entered above the airport crosswind leg causing a very close encounter. ATC apparently was not aware.
