Narrative:

Having flown the bitho 5 to orl many times, I knew that center/approach would have us below 10000'. For around 60 mi and less than 4000' for over 30 mi, with the great number of slow aircraft in central florida, this is a dangerous procedure. Small, fast turbojets must not be subjected to the potential for midair. I began begging not to be run down as soon as center started our descent. Once on daytona approach I asked again. Controller said no so fast that it was obvious that he would not attempt to accommodate. I made the mistake of stating that the procedure was going to kill somebody. Words were exchanged. I said no more and followed all commands. I held my tongue and didn't ask who would be responsible for the safe conduct of flight. The SID requires, and we were given, 17 NM south of omn VOR at 8000'. We leveled at 5 NM at 250 KTS and slowing. When our DME was reading 16.7 the controller stated smugly 'I show you past lamma at this time', as if he wanted the tape to nail us. He obviously accused us without directly saying we were high. We gave a normal rate of descent and made the restriction. If this controller wants to make an issue of the procedure I would have been glad to discuss it on the ground. We both made matters worse by our exchange, but no one needs a vendetta! To have prevented this occurrence I could have blindly followed orders and taken the chance that a non participating VFR wouldn't have been in my path. However, I feel bad sids/stars, etc which endanger, cause noise and burn fuel, must be changed. Once on the ground I called (for the 3RD time) mco plans and procedures and the orl area FSDO and complained. I am in the process of a written complaint. We can only hope!

I SAID NO MORE AND FOLLOWED ALL COMMANDS. I HELD MY TONGUE AND DIDN'T ASK WHO WOULD BE RESPONSIBLE FOR THE SAFE CONDUCT OF FLT. THE SID REQUIRES, AND WE WERE GIVEN, 17 NM S OF OMN VOR AT 8000'. WE LEVELED AT 5 NM AT 250 KTS AND SLOWING. WHEN OUR DME WAS READING 16.7 THE CTLR STATED SMUGLY 'I SHOW YOU PAST LAMMA AT THIS TIME', AS IF HE WANTED THE TAPE TO NAIL US. HE OBVIOUSLY ACCUSED US WITHOUT DIRECTLY SAYING WE WERE HIGH. WE GAVE A NORMAL RATE OF DSCNT AND MADE THE RESTRICTION. IF THIS CTLR WANTS TO MAKE AN ISSUE OF THE PROC I WOULD HAVE BEEN GLAD TO DISCUSS IT ON THE GND. WE BOTH MADE MATTERS WORSE BY OUR EXCHANGE, BUT NO ONE NEEDS A VENDETTA! TO HAVE PREVENTED THIS OCCURRENCE I COULD HAVE BLINDLY FOLLOWED ORDERS AND TAKEN THE CHANCE THAT A NON PARTICIPATING VFR WOULDN'T HAVE BEEN IN MY PATH. HOWEVER, I FEEL BAD SIDS/STARS, ETC WHICH ENDANGER, CAUSE NOISE AND BURN FUEL, MUST BE CHANGED. ONCE ON THE GND I CALLED (FOR THE 3RD TIME) MCO PLANS AND PROCS AND THE ORL AREA FSDO AND COMPLAINED. I AM IN THE PROCESS OF A WRITTEN COMPLAINT. WE CAN ONLY HOPE!
