Narrative:

Prior to leaving dallas, I was told to pick-up a company employee, mr 'a' in lbb and bring him to dallas (part 91). Mr 'a' met me at the aircraft while I was unloading the aircraft. I completed a preflight inspection of the aircraft and gave mr 'a' a passenger briefing. During en route cruise phase, mr 'a' said he was tired and went to sleep. He moved around quite often while he was sleeping! Upon reaching dallas, a normal let-down was accomplished and I set-up for the ILS 31L approach to dallas love field. (Went through descent and before landing checklists) approximately 1-1 1/2 mi outside the OM I lowered approach flaps and gear. The gear didn't seem to go down like normal, so I recycled the gear, got the green gear down light and initiated the approach. (Normal approach). Went through the flair and landed abruptly! When the aircraft came to a complete stop, I looked down and the gear was in the up position. (Red light gear) my hypothesis is my passenger must have kicked it somewhere in the approach while he was sleeping. I made sure it was 'down and in the green' outside the OM. I learned to make a final check at the middle marker, and prior to flare out to double check and triple check that the gear and flaps are down. (Before landing checklist). Also, a few days later, I learned that mr 'a' had been drinking with a few friends prior to the flight. When I met mr 'a' he was not staggering, no speech impairment, it was early am! He was also chewing tabacco. I have no formal training in alcohol or drug evaluation. The airport police at the scene did not detect any intoxication, nor the FAA on the scene. The police are trained to evaluate intoxicated individuals!! I learned that I should ask more questions prior to letting a passenger on the aircraft. But mr 'a' did not appear intoxicated to me!!

Title: TWIN ENGINE SMT LANDS GEAR UP AT DAL IN MIDDLE OF NIGHT, PLT CLAIMS PASSENGER WAS SLEEP KICKING.

(WENT THROUGH DSCNT AND BEFORE LNDG CHKLISTS) APPROX 1-1 1/2 MI OUTSIDE THE OM I LOWERED APCH FLAPS AND GEAR. THE GEAR DIDN'T SEEM TO GO DOWN LIKE NORMAL, SO I RECYCLED THE GEAR, GOT THE GREEN GEAR DOWN LIGHT AND INITIATED THE APCH. (NORMAL APCH). WENT THROUGH THE FLAIR AND LANDED ABRUPTLY! WHEN THE ACFT CAME TO A COMPLETE STOP, I LOOKED DOWN AND THE GEAR WAS IN THE UP POS. (RED LIGHT GEAR) MY HYPOTHESIS IS MY PAX MUST HAVE KICKED IT SOMEWHERE IN THE APCH WHILE HE WAS SLEEPING. I MADE SURE IT WAS 'DOWN AND IN THE GREEN' OUTSIDE THE OM. I LEARNED TO MAKE A FINAL CHK AT THE MIDDLE MARKER, AND PRIOR TO FLARE OUT TO DOUBLE CHK AND TRIPLE CHK THAT THE GEAR AND FLAPS ARE DOWN. (BEFORE LNDG CHKLIST). ALSO, A FEW DAYS LATER, I LEARNED THAT MR 'A' HAD BEEN DRINKING WITH A FEW FRIENDS PRIOR TO THE FLT. WHEN I MET MR 'A' HE WAS NOT STAGGERING, NO SPEECH IMPAIRMENT, IT WAS EARLY AM! HE WAS ALSO CHEWING TABACCO. I HAVE NO FORMAL TRNING IN ALCOHOL OR DRUG EVALUATION. THE ARPT POLICE AT THE SCENE DID NOT DETECT ANY INTOXICATION, NOR THE FAA ON THE SCENE. THE POLICE ARE TRAINED TO EVALUATE INTOXICATED INDIVIDUALS!! I LEARNED THAT I SHOULD ASK MORE QUESTIONS PRIOR TO LETTING A PAX ON THE ACFT. BUT MR 'A' DID NOT APPEAR INTOXICATED TO ME!!
