Narrative:
I was conducting a multi-engine training flight, originating in the mry arsa. Nothing unusual occurred during the flight, and upon landing back at mry pilot was requested to phone tower. He did this and was informed by controller that controller had advised us of traffic several times with no response. We had responded several times to such calls, but apparently missed some. We were outside the arsa during this time, but were still on radar advisory. The discussion was completed and the tower supervisor seemed appeased. Nothing more was heard on subject until several weeks later, when I received a call from an FSDO sjc rep, telling me that he was investigating the incident and asking for some further details. In 5/90 I received a formal letter from FSDO stating that I was being investigated for an far violation connected with this incident, namely giving multi-engine instruction west/O a valid medical in possession to a pilot who was not multi-engine rated. The allegation is correct in that I do not currently possess a medical certificate. However, my understanding is that as long as I have a current CFI rating on the aircraft concerned, and am current, I can give instruction to a pilot who has a certificate, a medical and a current BFR (the pilot in this case was commercial, second class medical and BFR). My basis for this understanding was information gained at several CFI refresher/renewal courses. Callback conversation with reporter revealed the following: reporter states he knows regulation and has been doing a great deal of instructing. He forgot all about the PIC aspect with this student. Since the controller did not receive a response to his calls, he filed a citation and the FAA investigated. In the process the lack of a current medical certificate was revealed. 8 yrs ago the reporter had a cerebral hemorrhage and his medical was not renewed in spite of many tests. Reporter has now gone back to AME and is making new efforts to activate his medical.

Title: INSTRUCTOR WITHOUT A CURRENT MEDICAL CERTIFICATE WAS GIVING MULTI-ENGINE INSTRUCTION TO A SINGLE ENGINE RATED PLT.
Narrative: I WAS CONDUCTING A MULTI-ENG TRNING FLT, ORIGINATING IN THE MRY ARSA. NOTHING UNUSUAL OCCURRED DURING THE FLT, AND UPON LNDG BACK AT MRY PLT WAS REQUESTED TO PHONE TWR. HE DID THIS AND WAS INFORMED BY CTLR THAT CTLR HAD ADVISED US OF TFC SEVERAL TIMES WITH NO RESPONSE. WE HAD RESPONDED SEVERAL TIMES TO SUCH CALLS, BUT APPARENTLY MISSED SOME. WE WERE OUTSIDE THE ARSA DURING THIS TIME, BUT WERE STILL ON RADAR ADVISORY. THE DISCUSSION WAS COMPLETED AND THE TWR SUPVR SEEMED APPEASED. NOTHING MORE WAS HEARD ON SUBJECT UNTIL SEVERAL WKS LATER, WHEN I RECEIVED A CALL FROM AN FSDO SJC REP, TELLING ME THAT HE WAS INVESTIGATING THE INCIDENT AND ASKING FOR SOME FURTHER DETAILS. HOWEVER, MY UNDERSTANDING IS THAT AS LONG AS I HAVE A CURRENT CFI RATING ON THE ACFT CONCERNED, AND AM CURRENT, I CAN GIVE INSTRUCTION TO A PLT WHO HAS A CERTIFICATE, A MEDICAL AND A CURRENT BFR (THE PLT IN THIS CASE WAS COMMERCIAL, SECOND CLASS MEDICAL AND BFR). MY BASIS FOR THIS UNDERSTANDING WAS INFO GAINED AT SEVERAL CFI REFRESHER/RENEWAL COURSES. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR STATES HE KNOWS REG AND HAS BEEN DOING A GREAT DEAL OF INSTRUCTING. HE FORGOT ALL ABOUT THE PIC ASPECT WITH THIS STUDENT. SINCE THE CTLR DID NOT RECEIVE A RESPONSE TO HIS CALLS, HE FILED A CITATION AND THE FAA INVESTIGATED. IN THE PROCESS THE LACK OF A CURRENT MEDICAL CERTIFICATE WAS REVEALED. 8 YRS AGO THE REPORTER HAD A CEREBRAL HEMORRHAGE AND HIS MEDICAL WAS NOT RENEWED IN SPITE OF MANY TESTS. RPTR HAS NOW GONE BACK TO AME AND IS MAKING NEW EFFORTS TO ACTIVATE HIS MEDICAL.
