Narrative:
While conducting a scheduled cargo flight part 135 from oak to sbp. Pilot requested WX information from ZLA. ZLA reported sbp clear and 10 NM visibility. As pilot approached sbp he noticed WX was 400' broken over 1/2 the field (see diagram) with tops about 800' and 15 NM visibility below. Since sunlight, sbp tower and all runways were visible to pilot, now 10 NM to the north, pilot asked ZLA for a SVFR clearance into sbp control zone. ZLA directed pilot to stand by and remain clear of sbp control zone as (pilot overheard) ZLA gave an IFR clearance and release to an small transport X flight and received an IFR to VFR on the request from an small aircraft Z. After a second request for SVFR from the pilot to ZLA, ZLA informed pilot that with sbp tower closed (to open at 00 local, time now 44). Control zone was not in effect. This was contrary to previous information obtained by the small transport Y pilot, but he assumed that a change had been made and that ZLA was correct. Pilot then terminated flight following (VFR) with ZLA and was directed to squawk 1200 and switch to 124.0, sbp CTAF. Pilot made at least 2 announcements on CTAF of position and intent to land on runway 11 entering on base leg. As pilot approached sbp from north, he observed small aircraft Z, west/O announcing intentions, take runway 29 and commence a takeoff roll while small transport Y pilot was turning final for runway 11 (see diagram). Small transport Y pilot altered course to south and passed small aircraft on his left. Closest point was approximately 350'. Small transport Y pilot circled to the left in VFR conditions and landed on runway 11. After landing pilot was requested to call the tower as tower personnel not yet on duty witnessed near miss. In the ensuing discussion with tower supervisor, it was determined that: pilot of small transport Y conducted his flight in accordance with far part 91, 135 and aim; pilot of small aircraft Z, although not in violation of FARS, failed to transmit intentions on CTAF at an uncontrolled field (tower personnel heard only small transport Y pilot radio calls); ZLA controller in error informed flight pilot sbp control xbp control zone not in effect; and no official report requested or filed with tower supervisor.

ZLA DIRECTED PLT TO STAND BY AND REMAIN CLR OF SBP CTL ZONE AS (PLT OVERHEARD) ZLA GAVE AN IFR CLRNC AND RELEASE TO AN SMT X FLT AND RECEIVED AN IFR TO VFR ON THE REQUEST FROM AN SMA Z. AFTER A SECOND REQUEST FOR SVFR FROM THE PLT TO ZLA, ZLA INFORMED PLT THAT WITH SBP TWR CLOSED (TO OPEN AT 00 LCL, TIME NOW 44). CTL ZONE WAS NOT IN EFFECT. THIS WAS CONTRARY TO PREVIOUS INFO OBTAINED BY THE SMT Y PLT, BUT HE ASSUMED THAT A CHANGE HAD BEEN MADE AND THAT ZLA WAS CORRECT. PLT THEN TERMINATED FLT FOLLOWING (VFR) WITH ZLA AND WAS DIRECTED TO SQUAWK 1200 AND SWITCH TO 124.0, SBP CTAF. PLT MADE AT LEAST 2 ANNOUNCEMENTS ON CTAF OF POS AND INTENT TO LAND ON RWY 11 ENTERING ON BASE LEG. AS PLT APCHED SBP FROM N, HE OBSERVED SMA Z, W/O ANNOUNCING INTENTIONS, TAKE RWY 29 AND COMMENCE A TKOF ROLL WHILE SMT Y PLT WAS TURNING FINAL FOR RWY 11 (SEE DIAGRAM). SMT Y PLT ALTERED COURSE TO S AND PASSED SMA ON HIS LEFT. CLOSEST POINT WAS APPROX 350'. SMT Y PLT CIRCLED TO THE LEFT IN VFR CONDITIONS AND LANDED ON RWY 11. AFTER LNDG PLT WAS REQUESTED TO CALL THE TWR AS TWR PERSONNEL NOT YET ON DUTY WITNESSED NEAR MISS. IN THE ENSUING DISCUSSION WITH TWR SUPVR, IT WAS DETERMINED THAT: PLT OF SMT Y CONDUCTED HIS FLT IN ACCORDANCE WITH FAR PART 91, 135 AND AIM; PLT OF SMA Z, ALTHOUGH NOT IN VIOLATION OF FARS, FAILED TO XMIT INTENTIONS ON CTAF AT AN UNCONTROLLED FIELD (TWR PERSONNEL HEARD ONLY SMT Y PLT RADIO CALLS); ZLA CTLR IN ERROR INFORMED FLT PLT SBP CTL XBP CTL ZONE NOT IN EFFECT; AND NO OFFICIAL RPT REQUESTED OR FILED WITH TWR SUPVR.
