Narrative:
Cleared from clt to rdu via the hornet departure from control. We intercepted the antsy right and were cleared to climb to 12000' MSL and contact ZTL. When handed off we were through approximately 10500'. ZTL cleared us to 17000' direct sandhill. Approximately 12500' we accelerated above 250 KTS, thinking there was no speed restriction. But alas, the departure had been changed and now there is a hard speed, until assigned by ATC, first officer 250 KIAS. Center asked us if we had accelerated, to which we replied affirmative. Altitude now 13500' and speed 290 KIAS. He asked if we had been assigned 250 KTS in the climb, and we replied neg. He said he would have the tapes pulled because he planned on 2540 KTS on all departures to ensure sep. We replied roger. A short time later he told us why clt clearance had not given FL250. The reason being that is published on SID. We apologized for the oversight, feeling humbled. However, I cannot recall another SID with a published climb restriction. The environment we operate in also fosters cay syndrome in that the first reaction to an infraction seems to be 'oh no, a violation, paperwork, NASA reports.' in the meantime, the cockpit environment is not stable because of confusion, professional pride being bruised, etc. Supplemental information from acn 152023: the SID was changed in june to reflect 250 KTS until advised, in print. We missed that part. However, in our opinion, the SID was terminated when we were cleared to sandhill VOR. This is the only SID I knew of that specifies maintain 250 KTS until advised by ATC. Our question is, was the restriction void when we were cleared direct to the VOR, since at that point we were off the SID? We never proceeded to the original departure gate we had been assigned to by clearance delivery.

OUR QUESTION IS, WAS THE RESTRICTION VOID WHEN WE WERE CLRED DIRECT TO THE VOR, SINCE AT THAT POINT WE WERE OFF THE SID? WE NEVER PROCEEDED TO THE ORIGINAL DEP GATE WE HAD BEEN ASSIGNED TO BY CLRNC DELIVERY.
