Narrative:
Air carrier X returning from paris had been cleared direct to yee from 20 mi so of lakes intersection. A climb to FL390 was also given. We were level FL390 and about 10 mi north of mt. Air carrier Y xed our altitude at a 30 degree angle. We asked montreal if he had an air carrier Y flight out here near us and he responded by saying 'yes at FL350'. We responded by saying 'negative he's at FL390.' controller simply said 'roger'. In my opinion this situation was probably controller error and that feeling comes because of the way the controller hushed the situation quickly.

Narrative: ACR X RETURNING FROM PARIS HAD BEEN CLRED DIRECT TO YEE FROM 20 MI SO OF LAKES INTXN. A CLB TO FL390 WAS ALSO GIVEN. WE WERE LEVEL FL390 AND ABOUT 10 MI N OF MT. ACR Y XED OUR ALT AT A 30 DEG ANGLE. WE ASKED MONTREAL IF HE HAD AN ACR Y FLT OUT HERE NEAR US AND HE RESPONDED BY SAYING 'YES AT FL350'. WE RESPONDED BY SAYING 'NEGATIVE HE'S AT FL390.' CTLR SIMPLY SAID 'ROGER'. IN MY OPINION THIS SITUATION WAS PROBABLY CTLR ERROR AND THAT FEELING COMES BECAUSE OF THE WAY THE CTLR HUSHED THE SITUATION QUICKLY.
