Narrative:

Between simones and alegre the WX was IFR with restr visibility and thunderstorm activity. Our flight was on the way northbound just prior to alegre when we received a clearance from havana center to climb. We were cleared to climb to FL350 from FL280, climb to reach FL350 by ursus and report to havana leaving FL310. We acknowledged the clearance, reported out of FL280 and upon departing FL310, reported out of FL310. The climb was IFR and normal. Upon contacting ZMA, we were notified an large transport Y reported a traffic conflict. It is important to note all 3 crew members heard the clearance from havana. We confirmed and read back with my entire flight crew monitoring havana. We did not hear any conversation between the air carrier and havana as to any traffic conflict, nor did we ever see the air carrier. Callback conversation with reporter revealed the following: reporter stated that the closest point between his aircraft and the other aircraft was 3 mi. The other aircraft was an large transport at FL310. He never saw the large transport. He filed a report about the incident with his company. Company responded that the controller at havana center erred when he issued the climb clearance to the reporter. ZMA has filed incident report with havana center management. No action is being taken against the reporter.

Title: HAVANA CENTER CTLR ISSUED A CLIMB CLRNC TO AN ACFT FROM FL280 TO FL350 IN ERROR WHICH RESULTED IN LESS THAN STANDARD SEPARATION FROM AN ACFT AT FL310.

Narrative: BTWN SIMONES AND ALEGRE THE WX WAS IFR WITH RESTR VISIBILITY AND TSTM ACTIVITY. OUR FLT WAS ON THE WAY NBND JUST PRIOR TO ALEGRE WHEN WE RECEIVED A CLRNC FROM HAVANA CENTER TO CLB. WE WERE CLRED TO CLB TO FL350 FROM FL280, CLB TO REACH FL350 BY URSUS AND RPT TO HAVANA LEAVING FL310. WE ACKNOWLEDGED THE CLRNC, RPTED OUT OF FL280 AND UPON DEPARTING FL310, RPTED OUT OF FL310. THE CLB WAS IFR AND NORMAL. UPON CONTACTING ZMA, WE WERE NOTIFIED AN LGT Y RPTED A TFC CONFLICT. IT IS IMPORTANT TO NOTE ALL 3 CREW MEMBERS HEARD THE CLRNC FROM HAVANA. WE CONFIRMED AND READ BACK WITH MY ENTIRE FLT CREW MONITORING HAVANA. WE DID NOT HEAR ANY CONVERSATION BTWN THE ACR AND HAVANA AS TO ANY TFC CONFLICT, NOR DID WE EVER SEE THE ACR. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR STATED THAT THE CLOSEST POINT BTWN HIS ACFT AND THE OTHER ACFT WAS 3 MI. THE OTHER ACFT WAS AN LGT AT FL310. HE NEVER SAW THE LGT. HE FILED A RPT ABOUT THE INCIDENT WITH HIS COMPANY. COMPANY RESPONDED THAT THE CTLR AT HAVANA CENTER ERRED WHEN HE ISSUED THE CLB CLRNC TO THE RPTR. ZMA HAS FILED INCIDENT RPT WITH HAVANA CENTER MGMNT. NO ACTION IS BEING TAKEN AGAINST THE RPTR.
