Narrative:
We were cleared to land on runway 27 san at least 5 mi out. About 2 mi out I noticed an medium large transport crossing the hold lines at the approach end of runway 27 and taxiing onto the runway. I pointed it out to my copilot. We waited to see what would happen. The jet was moving too slowly to be lined up and ready to go before we got there. At about 3/4 mi to the field, I called the tower and said, 'do you want us, X, to go around?' the tower replied, 'no X, you are cleared to...X, go around.' 'medium large transport, you were told to hold short of the runway; taxi into position and hold.' medium large transport did not reply. We overflew the aircraft on the runway at about 500'. I called the tower after we landed and he confirmed the medium large transport did not have a clearance to be on the runway.

Title: MLG ACFT MOVED ONTO RWY IN TKOF POSITION. APCHING LTT THAT HAD BEEN CLEARED TO LAND WAS INSTRUCTED TO GO AROUND.
Narrative: WE WERE CLRED TO LAND ON RWY 27 SAN AT LEAST 5 MI OUT. ABOUT 2 MI OUT I NOTICED AN MLG XING THE HOLD LINES AT THE APCH END OF RWY 27 AND TAXIING ONTO THE RWY. I POINTED IT OUT TO MY COPLT. WE WAITED TO SEE WHAT WOULD HAPPEN. THE JET WAS MOVING TOO SLOWLY TO BE LINED UP AND READY TO GO BEFORE WE GOT THERE. AT ABOUT 3/4 MI TO THE FIELD, I CALLED THE TWR AND SAID, 'DO YOU WANT US, X, TO GO AROUND?' THE TWR REPLIED, 'NO X, YOU ARE CLRED TO...X, GO AROUND.' 'MLG, YOU WERE TOLD TO HOLD SHORT OF THE RWY; TAXI INTO POS AND HOLD.' MLG DID NOT REPLY. WE OVERFLEW THE ACFT ON THE RWY AT ABOUT 500'. I CALLED THE TWR AFTER WE LANDED AND HE CONFIRMED THE MLG DID NOT HAVE A CLRNC TO BE ON THE RWY.
