Narrative:
On departure from ewr, advised was on frequency in addition to (ourselves). Controller instructed us turn right to 360 degree, climb to 15000' and intercept J95. My first officer read back this clearance and got no correction from the controller. First officer went off ATC radio to call company. Passing 14600' I saw traffic at 12 O'clock high and asked the controller to verify the altitude cleared to. There was no conflict with the traffic I inquired about. The controller said 'you've already busted it, climb to 16000'.' nothing else was said on the radios and before leaving her frequency, asked for a phone number to call departure control when I got on the ground. Speaking with the area manager on the phone, he said he could not pull the tape unless I filed a report. I just wanted to determine who was wrong. This incomplete information leaves a nagging question in my mind. Similar sounding call signs was possibly a factor.

Title: FLT CREW OF MLG READ BACK CLRNC TO 15000'. AT APPROX 14600' SAW TRAFFIC PASS AHEAD AT 15000'. DEP CTLR GAVE NEW CLRNC TO GO TO 16000'.
Narrative: ON DEP FROM EWR, ADVISED WAS ON FREQ IN ADDITION TO (OURSELVES). CTLR INSTRUCTED US TURN R TO 360 DEG, CLB TO 15000' AND INTERCEPT J95. MY F/O READ BACK THIS CLRNC AND GOT NO CORRECTION FROM THE CTLR. F/O WENT OFF ATC RADIO TO CALL COMPANY. PASSING 14600' I SAW TFC AT 12 O'CLOCK HIGH AND ASKED THE CTLR TO VERIFY THE ALT CLRED TO. THERE WAS NO CONFLICT WITH THE TFC I INQUIRED ABOUT. THE CTLR SAID 'YOU'VE ALREADY BUSTED IT, CLB TO 16000'.' NOTHING ELSE WAS SAID ON THE RADIOS AND BEFORE LEAVING HER FREQ, ASKED FOR A PHONE NUMBER TO CALL DEP CTL WHEN I GOT ON THE GND. SPEAKING WITH THE AREA MGR ON THE PHONE, HE SAID HE COULD NOT PULL THE TAPE UNLESS I FILED A RPT. I JUST WANTED TO DETERMINE WHO WAS WRONG. THIS INCOMPLETE INFO LEAVES A NAGGING QUESTION IN MY MIND. SIMILAR SOUNDING CALL SIGNS WAS POSSIBLY A FACTOR.
