Narrative:
On takeoff roll on 9L we encountered a small single engine small aircraft Y continuing through the intersection of 13 and 9L. We had been cleared for takeoff west/O any warning of someone landing on another runway holding short of ours. Evasive action was taken to avoid hitting the small aircraft Y. A normal stop was completed and taxied back to gate to assess damage. The abort speed was approximately 100-110 KTS. I don't think small aircraft Y saw us until was passed in front of him. We were never warned by the tower at any time before or during takeoff roll. Callback conversation with reporter revealed the following: reporter also filed captain's report with company and copy to FAA. Later was advised that FAA was investigating and that tower local controller and small aircraft pilot were both at fault. Both aircraft on tower frequency at time of conflict, but flight crew of X had heard no radio calls between tower and small aircraft Y. Small aircraft Y did stop at edge of runway 9L as air carrier X swerved to right side of runway. No damage to X. Tower said that small aircraft Y had been told to hold short of 9L. Small aircraft Y had apparently landed well short of intersection, but was fast taxiing through 9L.
Original NASA ASRS Text
Title: GND NMAC BETWEEN MLG ACR AND SMA. OPERATIONAL ERROR.
Narrative: ON TKOF ROLL ON 9L WE ENCOUNTERED A SMALL SINGLE ENG SMA Y CONTINUING THROUGH THE INTXN OF 13 AND 9L. WE HAD BEEN CLRED FOR TKOF W/O ANY WARNING OF SOMEONE LNDG ON ANOTHER RWY HOLDING SHORT OF OURS. EVASIVE ACTION WAS TAKEN TO AVOID HITTING THE SMA Y. A NORMAL STOP WAS COMPLETED AND TAXIED BACK TO GATE TO ASSESS DAMAGE. THE ABORT SPD WAS APPROX 100-110 KTS. I DON'T THINK SMA Y SAW US UNTIL WAS PASSED IN FRONT OF HIM. WE WERE NEVER WARNED BY THE TWR AT ANY TIME BEFORE OR DURING TKOF ROLL. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR ALSO FILED CAPT'S RPT WITH COMPANY AND COPY TO FAA. LATER WAS ADVISED THAT FAA WAS INVESTIGATING AND THAT TWR LCL CTLR AND SMA PLT WERE BOTH AT FAULT. BOTH ACFT ON TWR FREQ AT TIME OF CONFLICT, BUT FLT CREW OF X HAD HEARD NO RADIO CALLS BETWEEN TWR AND SMA Y. SMA Y DID STOP AT EDGE OF RWY 9L AS ACR X SWERVED TO RIGHT SIDE OF RWY. NO DAMAGE TO X. TWR SAID THAT SMA Y HAD BEEN TOLD TO HOLD SHORT OF 9L. SMA Y HAD APPARENTLY LANDED WELL SHORT OF INTERSECTION, BUT WAS FAST TAXIING THROUGH 9L.
