Narrative:

Pilot called patuxent approach and requested a clearance to continue present course south along the shoreline at 1000' or less. The course would transition the air traffic area and R4007. Approach assigned a transponder code and acknowledged radar contact. Pilot continued course into the air traffic area and R4007. About 8 mi into R4007, pilot was told by approach he had not issued a clearance and gave pilot vectors out of the airspace. The pilot made a very specific request. Flying a seaplane, he wanted to remain over water whenever possible. If approach could not grant the requested clearance, the pilot should have been told on initial contact and not drawn into the ATC system with a transponder code. Denied clearance, the pilot would have altered course and remained clear of the air traffic area and the restr areas.

Title: GA SMA UNAUTH PENETRATION OF AIRSPACE.

Narrative: PLT CALLED PATUXENT APCH AND REQUESTED A CLRNC TO CONTINUE PRESENT COURSE S ALONG THE SHORELINE AT 1000' OR LESS. THE COURSE WOULD TRANSITION THE ATA AND R4007. ABOUT 8 MI INTO R4007, PLT WAS TOLD BY APCH HE HAD NOT ISSUED A CLRNC AND GAVE PLT VECTORS OUT OF THE AIRSPACE. THE PLT MADE A VERY SPECIFIC REQUEST. FLYING A SEAPLANE, HE WANTED TO REMAIN OVER WATER WHENEVER POSSIBLE. IF APCH COULD NOT GRANT THE REQUESTED CLRNC, THE PLT SHOULD HAVE BEEN TOLD ON INITIAL CONTACT AND NOT DRAWN INTO THE ATC SYS WITH A XPONDER CODE. DENIED CLRNC, THE PLT WOULD HAVE ALTERED COURSE AND REMAINED CLR OF THE ATA AND THE RESTR AREAS.
