Narrative:
Small aircraft X reported 8 mi north over suison bay to concord tower and was told to enter right downwind for runway 32R. Tower departed small aircraft Y on runway 32R with a downwind departure and advised 'him' I was inbound from the north as he was rolling down the runway. He acknowledged. As I turned downwind small aircraft Y climbed below me and appeared at my 10:30 at 200 ft away. I was never advised of this traffic and he advised only once of me. The tower controller seemed to have a cold and was very defensive when we (small aircraft Y pilot and myself) considered controller in error.

Title: SMT X HAD NMAC WITH SMA Y. SEE AND AVOID CONCEPT.
Narrative: SMA X RPTED 8 MI N OVER SUISON BAY TO CONCORD TWR AND WAS TOLD TO ENTER R DOWNWIND FOR RWY 32R. TWR DEPARTED SMA Y ON RWY 32R WITH A DOWNWIND DEP AND ADVISED 'HIM' I WAS INBOUND FROM THE N AS HE WAS ROLLING DOWN THE RWY. HE ACKNOWLEDGED. AS I TURNED DOWNWIND SMA Y CLBED BELOW ME AND APPEARED AT MY 10:30 AT 200 FT AWAY. I WAS NEVER ADVISED OF THIS TFC AND HE ADVISED ONLY ONCE OF ME. THE TWR CTLR SEEMED TO HAVE A COLD AND WAS VERY DEFENSIVE WHEN WE (SMA Y PLT AND MYSELF) CONSIDERED CTLR IN ERROR.
