Narrative:
Airlines flight in aug, 91. The flight was a regularly scheduled flight from yyz to mia. The aircraft was near maximum gross weight. Takeoff temperature was in the mid 80's (F). The aircraft was operated with standard noise abatement airlines procedures for the large transport. Maximum power was used for runway 6R, climb power was used after the flaps were raised to 2 degree, then the flaps were retracted to 0 degree. The SID was flown as published for 6R and subsequent ATC instructions were followed. The takeoff and departure were normal. After returning to home base a week later, we were informed that a noise complaint had been filed against us and that enforcement action was being taken. In my opinion, the complaint is unfounded. To correct this, the SID should be published to avoid any noise sensitive areas.

Title: NOISE ABATEMENT PROC POLICY AT YYZ ALLEGED TO HAVE BEEN VIOLATED BY ACR LGT ON 6R DEP PROC.
Narrative: AIRLINES FLT IN AUG, 91. THE FLT WAS A REGULARLY SCHEDULED FLT FROM YYZ TO MIA. THE ACFT WAS NEAR MAX GROSS WT. TKOF TEMP WAS IN THE MID 80'S (F). THE ACFT WAS OPERATED WITH STANDARD NOISE ABATEMENT AIRLINES PROCS FOR THE LGT. MAX PWR WAS USED FOR RWY 6R, CLB PWR WAS USED AFTER THE FLAPS WERE RAISED TO 2 DEG, THEN THE FLAPS WERE RETRACTED TO 0 DEG. THE SID WAS FLOWN AS PUBLISHED FOR 6R AND SUBSEQUENT ATC INSTRUCTIONS WERE FOLLOWED. THE TKOF AND DEP WERE NORMAL. AFTER RETURNING TO HOME BASE A WK LATER, WE WERE INFORMED THAT A NOISE COMPLAINT HAD BEEN FILED AGAINST US AND THAT ENFORCEMENT ACTION WAS BEING TAKEN. IN MY OPINION, THE COMPLAINT IS UNFOUNDED. TO CORRECT THIS, THE SID SHOULD BE PUBLISHED TO AVOID ANY NOISE SENSITIVE AREAS.
