Narrative:

Not sure of interpretation of FARS (flight time) for supplemental carriers. Flight was rted miami-rio-santiago (chile) for total of 12 hours 42 mins. First leg mia-rio was live cargo flight then second leg was ferry to santiago. Aircraft completely empty. Crew took 12 hours block-to-block and then flew santiago-miami-jfk. First leg on this day was live cargo scl-mia and second leg ferry empty, mia- jfk. The problem is, upon reaching miami, crew had 21 hours and 21 mins flight time. Did crew need to step down in mia for 18 hours or is continuation of flight to jfk as ferry ok? (20 hours in 48 hour period). Crew did not notice the possible problem in miami as they were focused on taking 18 hours rest in jfk due to 20 hours in 48 hour period or 24 in a 72 hour period. The possible violation of crew rest wasn't caught by crew until en route mia-jfk which prompted this report.

FIRST LEG MIA-RIO WAS LIVE CARGO FLT THEN SECOND LEG WAS FERRY TO SANTIAGO. ACFT COMPLETELY EMPTY. CREW TOOK 12 HRS BLOCK-TO-BLOCK AND THEN FLEW SANTIAGO-MIAMI-JFK. FIRST LEG ON THIS DAY WAS LIVE CARGO SCL-MIA AND SECOND LEG FERRY EMPTY, MIA- JFK. THE PROBLEM IS, UPON REACHING MIAMI, CREW HAD 21 HRS AND 21 MINS FLT TIME. DID CREW NEED TO STEP DOWN IN MIA FOR 18 HRS OR IS CONTINUATION OF FLT TO JFK AS FERRY OK? (20 HRS IN 48 HR PERIOD). CREW DID NOT NOTICE THE POSSIBLE PROBLEM IN MIAMI AS THEY WERE FOCUSED ON TAKING 18 HRS REST IN JFK DUE TO 20 HRS IN 48 HR PERIOD OR 24 IN A 72 HR PERIOD.
