Narrative:
We were on an ILS approach to runway 30 at lgb. We were cleared to land at the OM. A plane was on the runway. I asked the controller if it would be departing soon as we were at decision height (230 ft approximately). The controller said 'yes.' I declared a missed because in my judgement the runway was not clear. The controller told me to hold my altitude which I did. We subsequently landed on 25R and the controller asked us to call. Upon calling the controller said that a plane declared a missed approach on 25L. He said that the plane passed over us at 70-150 ft. I explained that I was cleared to land on 30. The controller indicated that the plane on the runway 30 did takeoff on time. I explained that when I declared a missed the airplane on 30 appeared to be on the runway still. I believe the controller should have provided greater separation of the plane on a missed for 25L. I did not see the plane on 25L nor did I see him pass over us. Declaring a missed on 30 at decision height (235 ft) should have no effect unless the controller put too many airplanes in one spot.

Title: RPTR CHOSE TO GAR RATHER THAN RELY ON ACFT Y TO CLR HIS RWY IN TIME. THIS CAUSED AN NMAC AND POSSIBLY A GND CRITICAL CONFLICT.
Narrative: WE WERE ON AN ILS APCH TO RWY 30 AT LGB. WE WERE CLRED TO LAND AT THE OM. A PLANE WAS ON THE RWY. I ASKED THE CTLR IF IT WOULD BE DEPARTING SOON AS WE WERE AT DECISION HEIGHT (230 FT APPROX). THE CTLR SAID 'YES.' I DECLARED A MISSED BECAUSE IN MY JUDGEMENT THE RWY WAS NOT CLR. THE CTLR TOLD ME TO HOLD MY ALT WHICH I DID. WE SUBSEQUENTLY LANDED ON 25R AND THE CTLR ASKED US TO CALL. UPON CALLING THE CTLR SAID THAT A PLANE DECLARED A MISSED APCH ON 25L.
