Narrative:

Training was in progress. Traffic was heavy. Air carrier X was told 'climb and maintain 10000, leaving 3000 turn right direct mxe, maintain speed 250.' he read back 'ok it's 13, direct mxe out of 2 and 250.' we caught the incorrect readback on the turning altitude but not the '13'. Later, I observed the aircraft climbing out of 11000 in ZNY airspace. I had him descend immediately to 10000 and advise ZNY immediately, there was no further incident. Supplemental information from acn 201478: shortly after takeoff, philadelphia departure control issued multiple instructions to us (bearing, altitude, airspeed restriction, may have included traffic) the captain read back the instructions, including '13000' altitude. The controller either concurred or did not answer, continuing to give instructions to other aircraft. ( I do not recall exactly, but he was very busy) however, the captain did answer with '13000' as the clearance and set it in the altitude alerter. I repeated '13000'. Passing 10000 ft, I called for 'climb check'. Passing 11000 ft, the captain called '2 to go' (2000 ft to go). Approaching 12000 ft, the controller radioed air carrier X began immediate descent to 10000 ft, or words to that effect. We descended to 10000 ft without incident. The controller made no mention of a conflict or violation. But I got the impression that 10000 ft was the clearance altitude. If 10000 ft was the clearance, he failed to correct the captain's readback of 13000 ft.

WE CAUGHT THE INCORRECT READBACK ON THE TURNING ALT BUT NOT THE '13'. LATER, I OBSERVED THE ACFT CLBING OUT OF 11000 IN ZNY AIRSPACE. I HAD HIM DSND IMMEDIATELY TO 10000 AND ADVISE ZNY IMMEDIATELY, THERE WAS NO FURTHER INCIDENT. WE DSNDED TO 10000 FT WITHOUT INCIDENT. THE CTLR MADE NO MENTION OF A CONFLICT OR VIOLATION. BUT I GOT THE IMPRESSION THAT 10000 FT WAS THE CLRNC ALT. IF 10000 FT WAS THE CLRNC, HE FAILED TO CORRECT THE CAPT'S READBACK OF 13000 FT.
