Narrative:
On takeoff from sby airport, I copied a clearance and did not hear anything about a departure void time. Being the WX was VFR, the captain and I took off VFR maintaining visual separation from traffic. When departure was contacted, he informed us traffic was too close for IFR separation. He misunderstood that we were not IFR at the time and we wanted to pick up an IFR from him.
