Narrative:

Copilot acknowledged ny departure instructions to climb to 16000 MSL for light transport. We were at 12000 and had filed for 16000 as a final altitude. Approximately 2 mins into our climb, out of 12000 we were asked by ny what we were doing. The controller stated he was showing our cpr light transport climbing out of 14500 ft. When our assigned altitude was 12000. We immediately acknowledged and descended back to 12000. When we questioned this controller about our previously acknowledged clearance to 16000 ft, he did not respond.

Title: AN ATC ALLEGED ALTDEV ALT EXCURSION.

Narrative: COPLT ACKNOWLEDGED NY DEP INSTRUCTIONS TO CLB TO 16000 MSL FOR LTT. WE WERE AT 12000 AND HAD FILED FOR 16000 AS A FINAL ALT. APPROX 2 MINS INTO OUR CLB, OUT OF 12000 WE WERE ASKED BY NY WHAT WE WERE DOING. THE CTLR STATED HE WAS SHOWING OUR CPR LTT CLBING OUT OF 14500 FT. WHEN OUR ASSIGNED ALT WAS 12000. WE IMMEDIATELY ACKNOWLEDGED AND DSNDED BACK TO 12000. WHEN WE QUESTIONED THIS CTLR ABOUT OUR PREVIOUSLY ACKNOWLEDGED CLRNC TO 16000 FT, HE DID NOT RESPOND.
